parkingeye mistake

Options
parked up at bolton hospital on a road between 2 staff car parks. the road has double yellow lines but have a blue badge a number of other cars were also parked there. Recieved a parking fine in the post saying i had parked onone or other of the staff car parks but they could only provide photographs of me going up the road and coming back down about 1 hour apart. i appealled tp POPLA but they have rejected my appeal, i included a link to a map showing where i parked but they could not click on links. i should have uploaded it. i could not find a way to upload on the site when i did my appeal. what should i expect next because i am not paying for somthing i did not do.

  • Ceo will not do anything as popla have looked at it. Just got a letter from parkingeye offering to reduce fine a a gesture of goodwill. Why if they are in the right.

    You simply reply and say POPLA makes no difference and as they are the principal and ParkingEye their agent, they can cancel charges at any time.

    ...really wish you'd done PLAN A first...!  Cases are so easy to get cancelled by landowners early on.

    Of course they could cancel it they contracted parking eye who are just a parking company not an authority.
    I doubt that your link to the parking area would have made any difference to the POPLA appeal that's not within their remit as such, you would have needed to reference other evidence such a signage. 
    POPLA who are hardly impartial anyway being paid for by the parking company, only accept appeals based on contract law, procedure, signage etc not what happened on the day.

    Parking on DYL's in a private car park is not the same as on the street, DYL's on private land mean what ever the private parking company say they mean on their signage, it's a honey trap that you fell right in to.

    I suspect though, as Parking Eye are the foremost lover of ANPR technology and don't do foot patrols where you parked was in fact a staff area covered by cameras and you parked in an area you were not authorised to.
    If the latter is the case then Parking Eye cannot make a contract with you for a parking event they prohibit.
    Also you have an invoice issued under contract law not a fine.

    Not that you pay. Ignore it unless you actually receive a court claim. Tell them if you move house, obviously.

    Thank you for your reply, however I am a little confused by your response mentioning POPLA, as i am sure you are aware POPLA has no bearing upon anything and as principal you are jointly and severally liable for the actions of your agents,m in this case the un -regulated parking company, Parking eye .
     POPLA is funded by the British Parking association  (BPA) and the BPA are a trade association and as such do not regulate or have any regulatory powers over their members, this is outlined on their website here: https://www.britishparking.co.uk/about under "What we dont do"
     Stating that Parking eye are unable to cancel as it has been to POPLA is inaccurate to put it mildly as they can cancel this at any time , however you appear to have been drawn into their lies and  deceit , likewise if they decide to pursue the matter to court they can discontinue the case at anytime .
     The NHS parking principles/Guidance clearly states "NHS organisations are responsible for the actions of private contractors who run car parks on their behalf." and as such you need to tell parking eye that they must cancel the parking charge notice and you must not accept any lies deceit or other excuses from this un regulated company .

     I look forward to your reply on this matter, and maybe you need to look into your relationship with this company and ensure that going forward you remove any unregulated parking company from your site, neither the BPA or the IPC are regulators and allowing companies that belong to these two organisations on your site you are putting the mental health and well being of your staff, patients and visitors  at risk as well as , in some cases risking  breaching patient confidentiality
     
    Again something along those lines, but you need to be forceful and blunt they have lied to you
