DCBL letter claiming I have a CCJ - I have paid to check with the register and I don't have one.

Hi
Letter received from dcbl, dated 16th November
NOTICE OF DEBT RECOVERY - Unpaid County Court Judgement £300.19
You have an unpaid County Court Judgement (CCJ) and..... the court have found in favour of our Client, deeming you liable for the debt.
Date of County Court Judgement 11/04/2023
I have only lived at 2 address in the last 14 years. I have paid the registry to check both. Both results are clear.
Are dcbl trying to trick me into thinking I have a CCJ? Has the registry made a mistake? Where else can I check? I have no other reference points other than my addresses. I am really worried I have one, but how can I be sure the reports from the registry are correct?
the final paragraph:
"You now have 14 days from the date of this letter to either pay the outstanding amount or call us to discuss repayment. This case is not subject to High Court or bailiff action, however should you fail to contact us, our Client may consider enforcement action."
Thank you for your help. 14 days from the date of the letter is Thursday. I am running out of time to find a CCJ that may not exist!

Which registry did you check with?
Send DCB Ltd a SAR by email to their DPO asking for all data held about you and your car VRM xxxxxxx.
Attach a copy of their letter, for context.
Don't email this SAR to DCBLegal by mistake!
And if you do have a CCJ - do NOT pay it off. Nonononono. Read the CCJ set aside section in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

hi
thanks for the reply.
the links on the gov.uk website were broken so I used
registry trust limited using their trust online service.

Also have you checked your credit reports to see if they show a CCJ.
If you don't already have access look on this site for details of how to get free access to check.
Again no need to spend money on this.2 -
Hi, the registry has confirmed the reports are correct and they even checked a longer version of my surname. How can dcbl word a letter claiming a court has ruled in favour of their client, when this is clearly not the case, and they are trying to trick me into paying a fine.
Have letters of his nature been addressed already on this forum?0 -
Yes loads of times. And there has always been a CCJ.
Do the SAR to find out more.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello again
thanks everyone for your help and responses.
i obtained a free check as advised above from clear score. There is no CCJ. My credit rating is very good.
i will do the SAR as advised.
my question is still the same, is this letter dishonest in that it’s telling me I have a CCJ in order to scare me into paying? Or is there still a possibility I have a CCJ, but it’s just that I cannot find it?
is there any disadvantage in doing the SAR, I.e. it lets them know I’m worried and that I’m actively aware of the parking fine?

We don't know. Hence the SAR suggestion ...but if you are sure there is no CCJ, there is an alternative approach - to just do nothing.
No-one will come knocking and you are right, doing a SAR might open a can of worms. Hmmm maybe do nothing at all. If this CCJ isn't known by Registry Trust then there is no CCJ as far as you are concerned.
You could just let sleeping dogs lie, I think.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OP
Contact DVLA and find out if any PPC has requested your details.3 -
Hi all, thanks for the responses. I am really astounded that it could be legal to send a letter telling me I have a CCJ, when I don't!
I am worried that a SAR would open a can of worms.
I have searched the forum but can't find any similar examples of people who have had the same letter, and not had a CCJ. Can anyone direct me to similar cases?0 -
I think you do have a CCJ but it has never made its way to the Registry Trust so isn't affecting you. Doesn't 'exist' - but does in the background...
I recall seeing that once in a Civil Enforcement Ltd PCN case -maybe a year ago - and the person just ignored it. No idea where it is and none of us has time to search and it's not going to be findable anyway, as the keywords wouldn't be specific enough.
Doing what Castle suggested is a good idea. It's free to ask the DVLA that question and will reveal if there was a PCN around the time your logbook had an old address.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
