Charging order by cabott

Options

Does anyone have any knowledge how to stop a creditor going through Northampton business court putting  charging order on the property
An interim order by Northampton business centre calling it a court order

The property already has a rx1 form on
But that doesn't stop any charging orders

Presuming that the creditor already has a legitimate CCJ against you and that you own the property, or st least a share of it? If that is the case then probably very little, other than pay the debt or agree a payment plan.

You need to urgently find out if there is a CCJ, if there is a CCJ in your name and you own a property then there is nothing to stop them putting a charging order on property you own.

What do you think the CCJ is for and how has it got to this stage? What correspondence have you had from the court?

Can you please clarify what the situation actually is, in as much detail as possible, as your initial question is quite vague.

Once a creditor has a CCJ, they can apply for a charging order straight away.

How that affects you will depend on if the property is jointly owned, and whose name the debt attached to the CCJ is in.

You are not entitled to see the "deed of assignment" as its a court document containing the names of numerous other debtors as well as yourself, you are however entitled to a copy of the "notice of assignment", but that has no relevance to your creditor obtaining a charging order.

Lets try it this way, what debt does this relate to, and how much is it for?

Do you own the property solely, or jointly with a partner?
