    The Judge won't know about mediation.

    Mention it at the hearing to show a course of conduct in this litigation which has been wholly unreasonable.

    Also take proof of emailing your WS to VCS because their classic tactic is for their legal rep to pretend they never got your WS.

    Ah I thought that missing mediation would be quite a big thing for the judge to take into account - I will make sure I mention it.

    I will also have proof of emailing the WS handy (the hearing is via telephone) - I received an auto reply from them so can use this.

    As I havent received their WS or a discountinuance should I email the court askign for it to be struck out?

    Make sure you apply for costs then - mention their failure to attend mediation, this is all unreasonable behaviour.

    The NoD can be added to the thread if this claim and NoD came from DCB Legal.  How did you find out it was discontinued?

    You could try to claim some minimal costs now (if you are out of pocket) if you are quick. This is already covered in the NEWBIES thread with a link to blue toffee's example of what to email to court.

    Thank you! The court emailed me to say so, I had spoken to them earlier and asked if they could inform me of any changes.

    As much as I would like to claim some costs, I believe these would be minimal and I dont really want to take a day off work if they contest them and it requires me to go to court.
