    No, the CNBC. 

    Tell him to ring AFRESH and not mention a word about £11. Do not say anything about that.

    It is LUDICROUS to charge for an email when the set aside fee he's paying is £275!

    0300 123 1057 is the number found on most, if not all, Claim Forms issued by the CNBC.

    I was really wondering whether your son had found a scam number - one that charges £11 but was unlikely to return anything.

  • Okay, I'll ask him to phone afresh and ask for a copy of POC so that he can enter a Set Aside plea as he has not received any paperwork so far and see what response he gets.  Thanks again everyone. 
  • Unfortunately I misunderstood and the guy on the phone sent him a text message with an email address to use to request the particulars.  He has already sent a reply to this address ccmcce-filing@justice.gov.uk and has included his phone number for them to request payment if it is needed.  I'll get him to say he shouldn't have to pay if they do phone him!!  Or should he just phone again as you suggested earlier?

    Just phone the CNBC number like everyone else does. No-one is ever charged anything and it's illegal where all he's asking for is the paragraphs with his car data.

  • Am i correct in thinking the POC CNBC will send him will be copies of the letters that were sent to his old address along including the LBC. I am assuming that's what he needs to start filling in the N244.

    No. It's just words from the Claim Form.

    He doesn't need any of the letters and there's no need to assume what is needed.  I give half a dozen links to successful CCJ set aside threads in the NEWIES thread already. They are linked there to be read and learned from.

    Another recent one is by @Chesterfield1970 who had already filled in his n244 before coming to this forum, but has now rescued it with a decent WS and bundle of evidence.

    All usernames take you to their threads, if you just take a look at their profile and click on Threads.

  • We are currently working through the N244 example in the link by Henrik777 - in Para 2. of the Draft order, he uses the term "indemnity basis" - from reading his link lower down, I think we just use the term "standard basis" - or do we just put "2. The Claimant do pay the Defendant's costs of this application (£275)"

    Also, in the Witness Statement in Para 6 there is a reference to the Claimant's response - should we be(or have already) sent anything to tell the Claimant we are sending in a request to Set Aside - my understanding is we don't because the Court will send them a copy of the N244 - however, I'm conscious of how long it is taking us to get all the knowledge we need.
