You should exhibit it as a PDF (full attachment).

Sorry if this has been answered elsewhere but my son emailed his DQ in good time for the deadline of 1st May to his local court (Doncaster) and the Claimant (Excel Parking) and has not received any acknowledgement from the local court (this has been the norm from this court to be honest) nor Excel.  But more worryingly is that he has not received a copy of the Claimant's DQ from Excel either.  I had assumed the Claimant would have the same instruction as he had i.e. to send a copy to all other parties in this claim.  Should he be chasing this up at all?

No need to chase up Excel's DQ.  It's not something you need.

But I would suggest your son forwards the DQ email & attachment again to the court (ONLY the court this time) and tells them in this email that he has filed and served his DQ on DATE - see below- but Excel (Claimant) has not served their DQ, so please could the case be put before a Judge to strike the claim out.

The post-CCJ Order will say what the Judge wanted. Were both parties ordered to file & serve DQs?

  • I understood the letter to mean exactly that

  • He followed the advice on here and emailed the N180 to the court, copying in the PPC and himself a couple of days before the deadline but didn’t get any acknowledgment from the court nor Excel. And he did check with the court, prior to sending, that they were happy to accept it via email.

Yep.  So now do what I advised.

  • I thought about suggesting he phone the court to double check that they received his DQ and ask if they had also received the Claimant's DQ. Or do you think it better to follow your suggestion as above?

  • Will do. Thanks.
  • Dear Sirs
Please note that, as per the Court Order to file and serve a Directions Questionnaire for the Small Claims Track by 1 May 2024, I (Defendant) filed and served my N180 form for Claim xxxxxxx on 28 April 2024 (see below).
However, Excel Parking Services Limited (Claimant) has not served their Directions Questionnaire, so please could the case be put before a Judge to strike the claim out.
    Yours Faithfully,

    will this suffice?
