Section 74 - used car - 15 months on

Hi folks,
So - we have a car that has had ENDLESS issues. Lots repaired under warranty. Some bits that they never managed to identify. I have paid several £1000 to the same garage for repairs over the last 15 months including failing its MOT. Asked them to buy it back (refused) and its starting another issue now.
I paid £100 deposit on my husbands CC. Its in my name but is our main family 4x4. Do i stand a chance with section 75??? Thanks.

So your husband is the debtor but the invoice for the car is in your name?
Assuming that is the case then no, you don't have the required Debtor-Creditor-Supplier relationships in place for S75 to apply.
You naturally still have the identical rights against the seller as you'd have against the bank.0 -
Failing MOT is just part & parcel of car ownership. Not a reason to start a claim.
As car is in your name & paid on husbands card. I would expect a straight out rejection of S75.
Is the garage you are paying the selling garage? Or a 3rd party. What have selling garage said?
