Kentucky Fried Ticket!! Help.

Hi All

Thanks for clicking my thread :)

I recently parked in a retail car park next to a KFC to meat a friend ;)

We ended up chatting for a while, KFC is located just outside of this car park but it is always full up so never any space to park there.

Long story short, I got a ticket for staying past the limit... I arrived at around 7:45pm and left around 9:30pm.

I appealed with the following below but it was rejected of course.

"I wish to appeal this parking ticket on the basis that your signage and maintenance of the car park are completely inadequate.

The driver of the vehicle at the time was visiting KFC which is located at the car park site.

Attached are photos from the car park and entrance way to the car park which clearly show that the signage and surrounding notices are;

1) Not clearly displayed or visible for the driver to make a reasonable decision to park at this car park, even from the entrance.

2) The signage is not clear and is out of view for a driver even when parked.

3) The car park is poorly lit and maintained and signs are not visible.

Until I received this parking ticket, I was not even aware that this car park had ANY restrictions.

I entered the car park when the rules where 3 hours from before 8:30pm.

I therefore believe that this PCN is unreasonably issued."

Any help would be greatly appreciated, I've tried to  claim 35 day no response, but turns out they did email me and are now demanding the payment promptly.

Please help :(

Thank you!

Plan A is always a complaint to the landowner and your MP, and it's never too late to do so.

What a shame you told the PPC you were driving in your initial appeal. Had you not, this could have been won at PoPLA on Non-PoFA compliant NTK.

It's too late now, but if you ever get another PCN from an unregulated private parking company, use the ready written appeal template in blue text that doesn't give away the driver's identity.

Did you get a PoPLA code?
If so, did you use it? They last 32 days.

Ignore powerless debt collectors. Otherwise there is little else you can do except wait to see if ECP try a court claim within 6 years of the date of the alleged event.

So should I just pay it to avoid the hassle and increased fine?

Don't remember seeing a popla code...

Don't know what to do :/

It is not a fine. Nobody here will advise you to pay an unregulated parking company; one of many referred to as rogues, scammers, and bloodsuckers by our MPs.

A PoPLA code should have been included in the rejection letter after your initial appeal.

'Kentucky Fried Ticket'?  I thought for a moment we had a new menu item! 🍗
I recently parked in a retail car park next to a KFC to meat a friend
    I assume there's a typo somewhere in that? 😄

At this stage a POPLA appeal is the way forward - assuming you've received a verification code with the ECP rejection of your initial appeal, and it's still 'in date' - but we need you to confirm what the position is on it, please.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Nonononono!  Not a single one of us is telling you to do that! No paying.

So, when you appealed it looks like you didn't say who was driving - good - in my opinion you didn't from those words; but did you tick 'registered keeper' or 'driver'?

And, you need to check your junk emails for the rejection letter (it has the POPLA Code) and tell us the date on that rejection?

What's the latest letter EXACTLY? Show us.

Too late for a POPLA appeal so just ignore it.  This (every stage) is all covered in the NEWBIES thread.

Please post the next letter. I asked exactly what it is.

Please post the next letter. I asked exactly what it is.
That is the latest letter I have received from my appeal, the only other correspondence is as per the below:

     PCN: xxxxxxxxxxxxxxxxxxx

I have sent an appeal regarding reference of the PCN issued above against my vehicle, it has now been 35 business days and I have not received any further correspondence from you.

I would like to refer you to the BPA CoP which can be found on their site.

It is clear that as 35 days have elapsed; you have failed to comply with the CoP as set out by the BPA I consider that any continued enforcement action as per the BPA CoP; as this has not been followed in this case, I now consider the matter closed.

I will also be notifying the BPA of this breach.

    --------

    I then received this response...

    Good day,

Please be advised that the appeal response letter was sent on 12/10/2023  via email.

     (log of sent email)

The parking charge notice is currently outstanding at £60.00. Prompt payment is advised.

    Regards

OK.  My advice is as above.  All of us are advising you to obviously ignore the daft threatograms. Nothing new. Nothing scary.

All stages covered in the NEWBIES thread.

You must tell ECP if your address changes.
