I think you will lose this POPLA appeal, unless the NTK is missing the words 'and pass the notice to the driver'?
I don't see a winning point otherwise but a court would think differently. PP now know that your passenger was disabled and on my interpretation of the EA, they ARE now (due to that knowledge) harassing and directly discriminating against that person (and you, as the carer that day).
Did you try asking Savills to step in first?
Appeal was never the first priority - this is the wrong order - and the NEWBIES thread makes it clear what PLAN A is (and will still be) if this is lost at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Plan A has been my focus from the start, I called umpteen telephone numbers daily for Savills to try to contact the right person for Stanly Green. It was only on Monday that I finally got the correct number and spoke to them. They said that because I have already started the POPLA appeal it is unlikely that they can now do anything.1 -

I would like to thank all those who helped me on here, you are all angels. Your guidance and all the information you helped me with was invaluable. I have never been on these forums before so had to learn how to to do it. I tried my best to follow everything you suggested. I wanted to update you on what happened with the popla appeal you guided me through before now but I just worked out how to get back on. I received an email from popla to log into the portal for the decision an I was shocked to see that my appeal was SUCCESSFUL.
I have copied and pasted the last paragraph from popla below….The British Parking Association (BPA) has a Code of Practice which set the standards its parking operators need to comply with. Section 21.5a states,” When issuing a parking charge notice you may use photographs as evidence that a vehicle was parked in an unauthorised way…All photographs used for evidence should be clear and legible”. In this case, I appreciate the parking operator has provided images of the vehicle on site. However, one image shows the rear of the vehicle, and therefore the dashboard is not shown, and the other two images are taken at the side and front of the car, and I am not satisfied that the entire dashboard is visible in these images due to reflections and rainfall on the windows. Therefore, I feel it is possible that the blue badge was displayed as the appellants says, and so I cannot conclude that this PCN was issued correctly. I note the appellant has raised other issues as grounds for appeal however, as I have decided to allow the appeal for this reason, I did not feel they required further consideration. Accordingly, I allow this appeal.
