DCB legal. UKPC is it too late to follow the forum.

A friend received letters to a Money claim gov uk. He is Eastern Europeans and his grasp of English is minimal to say the least.

We only had like a day or two to reply as it was close to the 14 days timescale. Managed to extend it and emailed the email address with evidence within the timescales.

UKPC took a picture of my friends car that was parked behind a store in their loading area next to their gate and away from the customer car park. They then took a picture of their parking notice from the customer car park as evidence of not parking in a bay/parking space.

A) in their picture of evidence it’s clear that there were no parking bays where my friend parked.

B) my friend went back and took 2 pictures of the same place one from far and one from a short distance to show that there were no signs visible at all because this area was in a private area. A barrier/gate has to be opened by the store member in order for the vehicle to enter the loading area. The signs picture was taken from the customer car park at the front of the store. This is about 100m away from this private loading area.

As soon as we sent that evidence by email to ccbcaq@ we got a response stating as follows:

Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim. In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

Q1. So now we just wait for the court to ask us fill a DQ? And when they do do we have to do it within 7 days?

Or do we fill one on now and sent it to court?

Q2. Is it too late to make a counterclaim as we only went for a defence? My friend had to drive back to that store several times to speak with the store team and to take pictures for evidence.

Q3. We don’t think they can win this as it’s a clear case of fraud. They are deceiving the court with false evidence. Can we not do anything about that fact? We did mention it in our defence that they’re deceiving the Court with the false evidence.

    Too late for a counterclaim.

DO NOT Mention the word 'fraud'.

What did the defence say?  I really hope it did not use words like fraud...

Why didn't they use our Template Defence, they had an extra two weeks to defend one they acknowledged the claim.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
