Possible pay problems

I won't go into too much detail but can anyone advise as to whether the company you work for,who pay your wages into the bank by the normal route,can take any back after you have left their employment?

There may be a dispute ref hubbys wages and as they have your bank details to pay money in i wondered if it worked like a direct debit,even if you haven't obviously given permission for that ?

Thanks for any advice you can offer.

    Depends on 'the normal route'? If it's BACS direct credit (which is normal for most people) - they can't 'recall' it ( or any of it) after the working day before its credited to your account. Thereafter they have to contact you for any money not due to you
    If you want to test the depth of the water .........don't use both feet !

    Check your husband's contract! In my contract, it states that I am liable for any 'debt' owed to the company as and when I leave. I don't know how they would actually retrieve the cash, but if it's not actually my money - including if it's paid in error - they will pursue it by court if necessary.

    If it's a dispute, I'd guess the dispute needs to be resolved before any action was taken by the company.

    It is possible to debit back the credit on the day of receipt but not after.

    Oh no,it is nothing like dishonestly acquired pay,but it is complicated.Suffice to say the employer will actually owe hubby more in untaken holiday,but being a difficult boss to say the least he may imagine he owes him for other things,and quite forget about the holidays he has not had.

    Anyway you have put our minds at rest,the code the bank uses is BC so i imagine it is normal BACS .

    Which is what I always thought - but the BACS FAQs disagree with us both and stipulate it is the day before credit.

    In my experience ( ie when ive cocked up ) i have had to ask very quicky for them to cance the payment
  • Manual recalls are allowed as long as they are done on the morning of the credit.
