Car holding deposit

Hi
My daughter recently bought a car from an independant dealer , she left a deposit over the phone so they would keep the car until she was able to go and see it . She bought the car but they didnt give her the deposit back which they have agreed they should have done , She has rang many times with them saying they will refund the next day nearly 3 months on and she still hasnt got it . She doesnt live local to the garage and doesnt feel very confident to go in face to face to ask for her money . Does anyone know if there is a legal reason for them giving back her money .

See a car online, say £5,000.
Phone up and pay a holding deposit, say £100.
Go and see the car and decide to buy.
Pay the balance £4,900.
No deposit to be returned.0 -
I've never had any deposit returned when I have made the purchase for which the deposit was given.
It is just deducted from the agreed purchase price as @Grumpy_chap posted above.
Time to get the invoice out and have a careful look.1 -
As above if you pay 500 deposit on a 10000 car the balance is 9500. Are you saying the 10000 was paid in addition. Surely that would be the first question when paying the balance? Are you certain that it has been overpaid0
