    strange thing is on the 3rd reply I did in this post, scroll back a bit please, the letter they sent saying the creditor will take longer than 12 days to supply CCA, the debt will continue to be registered and reported as a default.then today they state in their reminder letter , please catch up arrears on repayment plan or they will report it as a default?

    it is never been registered as defaulted in my credit report
    checked today,it is still showing account active. not showing defaulted.

    so what's going on.whats this letter today headed account now closed they sent with the CCA agreement. and the other two letters ,one from a few weeks stating account registered as defaulted and the reminder one saying please catch up repayments on plan or it will be defaulted.
    Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

    By far the majority of letters these chancers send are generic template letters that may or may not be appropriate for your situation, you have to decipher which apply to your circumstances and which don`t.

    the CCA agreement is about 10 pages of A4 text like a school project. eg short paragraphs. with large white spaces between each one. with headings.
    it has the date I took it out. my address etc , but it does not resemble the 3 page Barclaycard standard typeface agreement I took out with them .
     it states in a separate page this debt is enforceable and account closed with the balance due.
    but if you read my posts I'm not sure if it ever defaulted.
     plus if they never enclosed any statements with the CCA agreement, even tho I asked for both. does that make it unenforceable .
    in a similar style that PRA are doing whilst they wait for more documents. eg statements, that I'm sure that PRA owe me.

    and I don't know which letter to trust. one that said we have the right to continue  to mark it as in default  on credit file or  one that said it may get registered.
     but on credit report it always shows account active

    is it active, what about account now closed  letter that came with their CCA.
    do I call their bluff and still refuse to pay until it defaults. then make payments.

    I mean even tho the debt was sold on.is it possible to sell a debt on that never defaulted. and even if the cca letter states enforceable. how can they action that in court if it hasn't ever reached default status.surely it has to default before a court claim can made

    I am sending an email to link asking is it defaulted or not. as in their letters it states we can register account as a default.

    and is it still active as it is always shown as active on my credit report.

    plus what does account now closed mean , in the first page if the CCA letter they sent 

    I assumed it was closed 2 years ago when I went in payment plan, as my card was cut up and no access to credit on the card was stated .. I will also state they failed in my  legal request for BOTH a cca and a statement of my account. as they never sent any statements.

    I will state no payments will be made untill they sent a statement and also no payments until the debt defaults.

     finally I will discuss a full and final price as the debt has been sold on at least once and is suitable for a reasonable discount.

    Account closed, means its no longer an active account.

    If the default is not on your credit file, then its not defaulted, as I said, generic template letter.

    You are unlikely to get a coherent response to those questions, just another badly worded generic letter that will likely just confuse you even more.

    email sent. I want a reply about the fact they aren't getting any payments from me until it defaults in writing AND they satisfy my request for BOTh the CCA and statement. as they have failed in their responsibility to provide both.
    they only provided the CCA and no statements

    got a call from link.i asked is it about the email I sent with all my questions.she said no.you owe us £34.
    I said look at email. ok she said
    so we came to a solution. yes the account is terminated.i cant  get credit on the card.i don't want any!!. I asked about default.
    she said account still  active.i said default it.she said she will do a manual default today. normally the do it after 3 months of missed payments.

    I said I wanted default in order for credit report to improve faster ,rather than an arrangement to pay marker.
    I asked about why no statements  sent with my cca letter.
    she said she will chase it up.i agreed only to pay installments if I get statements and default.
    I then said no more calls.writing only.agreed she said.. I said I will do a standing order at my price.she said phone them.why I asked.she said you have to .no I said I'm up to date with priority debts, hence my plan will be affordable.

    she said I may get letters and calls again.even if I set up a plan, but don't discuss the plan with them.

    she said I may get bank charges if my direct debits don't go through ,if I fail to pay.

    I said I'm doing standing order only.

    we then discussed full and final settlement figures.she said phone or write. she said  I name my offer  price, but state if not acceptable agree to link  hit. me back with their offer. valid for 14 days.
     I said ok, bye.

     note.she did say she want trained with bankruptcy, DRO and was simply taking notes what I said and discussing payment.
    she was impressed with my knowledge about debt recovery and my rights.
    thanks to this forum.
