Link financial outsourcing being difficult, now got a final response.but confused

I wrote a CCA letter to Link Financial resourcing on 23rd October  with the  £1 cheque enclosed asking for a copy of my consumer credit agreement and a statement, I posted it to the address on their website  Link Financial Outsourcing Limited, PO Box 107, Caerphilly CF83 3GG, via 1st class signed for recorded delivery. It arrived 24th  October and was signed for  by a person at Caerphilly D.O., as i used royal mail track and trace.
 
I wrote to them a few days ago via their  Link Financial website portal, asking where is my consumer credit agreement.

I got an email today it reads--
Thank you for your enquiry received via our Self Service Web Portal. In response we haven’t received your request for the Copy of Consumer Credit Agreement, we have now requested this for you. Please be aware as we need to request this information from Newday Ltd (Aqua), this can take a few weeks to be received. Once we have received this we will send to you.

 My original debt was with Newday who owns aqua credit card, but on July 2023, it was sold to LC asset 2 and Link Financial Outsourcing  will own the debt and take over responsibility.
I emailed Link Financial  back this evening stating   i had proof of my letter arriving with them and i will not pay any money to them ,whilst they search for the consumer credit agreement AND statement from the original owner, Newday,.
what is my next step, why are Link denying they never got my CCA  letter.

Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

    Stu, just sit tight & wait. There is no point in getting in a tizz about your CCA requests, you are not paying anyone while they dig out the paperwork so just sit back, build your emergency fund and wait for responses.

    yes. but what I don't further down the line is a creditor saying you never ever asked for proof of your agreement.

    On link website they say contact us at their po box address in caerphilly. but they also state write to us at our business registered address in London. they can't tell customers two different addresses to write to.
    it does say the London address is corporate enquiries.
    I am just not keen writing to PO box numbers, but that is where they say write to on their website for customers in arrears.

    I got an email today it reads--

    Save that email, as it states that they have requested the CCA for you. It might be that there is a delay in processing mail received & passing it to the correct team.

    It's been 3 weeks, it will depend how often their post is processed.

    As said, just sit tight and wait. I wouldn't bother chasing any of them for a reply or acknowledgement  -it won't change anything if you do.

    I requested a CCA using their PO Box address. They wrote to me about three weeks later saying they had requested the CCA from MBNA and they sent me a copy of it about three weeks after that. I just used normal post for me CCA request, I seem to remember that sending things recorded delivery to PO boxes can slow things down, but I can't remember why.

    I wouldn't bother chasing them - you don't want them to produce it and it's unenforceable until they do.

    Link is a massive company, many people work there, post can get mis-placed, lost, sent to the wrong office etc.

    Also the letter/email templates they use are always ambiguous, and never address the subject you initially contacted them about, its a deliberate measure they always employ, get used to it.

    link financial wrote to me today saying that the creditor can't adhere to my 12 day timeframe  CCA request.
    even though I wrote to link over 5 weeks ago .they said the debt is currently unenforceable, but remains collectable and will continue to be registered  and reported as a default.
    they said they will inform me upon receipt on an update from original creditor.

    I'm still currently not paying them

    This is pretty typical, it was about three months before PRA wrote to me to say that Barclaycard couldn't produce the CCA.

    this is a £770 , 7 yr old aqua card debt.
    but my pra debt is a  10 yr old Barclaycard debt for £5500.
    pra said they are looking for the CCA,but account is on hold for last 5 weeks

  • The problem with signed-for to a PO Box is that you only get the signature from the delivery office as you’ve found - the whole PO Box system does give the companies room to claim they’ve not had things even when they patently have!
