ICELAND //  Excel Parking

Hey everyone,

Just wondering what best course of action is now and whether there is anything we will be able to do to get rid of this PCN with based on the letters they have sent, or whether we should just pay.

My partner popped in to Iceland for 20 minutes. He has receipts to prove patronage. He’s pretty sure he paid for parking, but was so long ago he can’t remember and he can’t find a parking receipt. There is a chance he may not have realised he needed to pay or forgot or machine wasn’t working or whatever. Look at state of that machine – held together with tape! Or maybe he got confused with the signage. Funny thing is they would have paid him back for the parking as he spent money there. Ulghh.

We moved in February. All the following letters were sent to our old address because we had only changed address with DVLA and forgotten V5C. Debt recovery got involved to the pre-legal stage. We changed V5C in May.

Via problems with another PCN we went to old address to find out we had lots of these fines, including this one.

My partner called Iceland in late june and the guy on the phone said it would likely be cancelled. He gave us an email, so we sent one asking for it to be cancelled, informing them of new address and thought everything would be OK. They did not respond to the email. We sent a follow up in early July.

After Debt Recovery Legal having been involved, they then returned to Excel sending a letter to our new address with a demand for 170 quid.

I’m attaching the signage at the car park, the first PCN, the first Debt Recovery letter and the letter sent to new address.

We can’t pay all these PCNs and need to know if theres any way out! Please help for best course of action and any potential defence. I know the fact we didn’t receive the letters is our fault. We’ve messed up any potential PoFA given the fact we contacted Iceland and admitted being the driver. Anything else we can do? Wait for court and see if they mess up with PoC?

Here's a timeline of notices incase that helps.

1.     Issue date 08/03/2023. : 1st PCN sent to old address - Contravention Date – 26/02/2023 - £100 fine

2.     06/04/2023 – Final Reminder

3.     25/04/2023 – Demand for payment £170

4.     15/06/23 – Debt Recovery Plus gets involved and sends a letter to old address still saying a tracing service was used and they found him and now owe 170 quid

5.     30/06/23 Terminal notice, pre  legal action from Debt Recovery Plus – old address

6.     13/07/23 Sent to New address from Excel Parking again – Demand for Payment of £170

    Complain to Iceland. Ignore DRP letters (NEWBIES FAQ Announcement, fourth post), come back if you receive a county court claim.

    Have you ever told Excel to erase the old address?  You MUST, and cannot assume they will use the right address for the court claim. Which is what you want...

    OK - Thank you - Will send an email to Excel Parking requesting delete of old address. Will email suffice? Do i need to do the same for the legal team they got involved? WIll also make a complaint to Iceland. Thanks again.

    You do have to laugh at those DR+ letters and the lies and rubbish they contain, they are just condescending waffle!
    Arthur Hobbs "my findings" you would be lead to believe he (if he is a real person) actually visited the site to confirm the signs are all in place it's a lie he doesn't know anything about the place!
    The flow chart utter panic inducing (not) and an option box is missing stating Ignore us we are just begging for money we aren't entitled to and cannot make you give us!
    As for the check list it looks like a school project! :D

    The word to use is ERASE as it has a specific meaning relating to data collection and storage. E-mail is fine you can use: -
    dataprotection@excelparking.co.uk
    In your e-mail to the DPO you require them to "inform each and every one of their agents and sub-contractors".

    And I suggest you redact your car photos in both those Excel letters as they show your numberplate.
