Should I answer yes or no for this question on the image regarding my partner who is on statutory maternity pay ( SMP ) ? The other image I guess we select Universal Credit as we currently get this?

It says underneath the part about earnings… it doesn’t matter if your partner doesn’t expect to earn this amount while they are on maternity leave. If they expect to be on this for the next 3 months you should tick “no.”

Yes of course it’s UC for the first question.

Thanks for replying to my post.

So even though my partner is on statutory maternity pay and gets £172.48 per week but gets it every 4-5 weeks like she did with her wage when she was working 35 hours per week I still say “NO”? I thought it would be “YES”? As she is getting more than £166.72 per week correct?

How long is the statutory maternity pay for ?
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

Partner went on SMP beginning of August 2023, and I think it lasts up to 39 weeks.

Should we answer yes or no then to that question as we like being correct and honest with all the answers we provide?

SMP is paid for up to 39 weeks, the first 6 at 90% of your wage and then 33 at either £172.48 or 90% of your wage (depending on which is lower). However your partner can return to work at any point as there is not compulsory set period of SMP (you can take upto 52 weeks mat leave - although I’m not sure what happens when the 39 weeks SMP ends for the remaining 13 weeks)
