    Maybe split this sentence into two...
    However this resulted in a technical allegation of 'overstay' of some minutes over the fixed policy of allowed parking time, and as the registered keeper of the vehicle, have since received a parking charge from UK Parking Control Ltd (UKPC).

    However this resulted in a technical allegation of 'overstay' of some minutes over the fixed policy of allowed parking time. As the registered keeper of the vehicle, I have since received a Parking Charge Notice from UK Parking Control Ltd (UKPC).

    Under the Equality Act 2010, parking operators, landowners, and their agents, must allow a 'reasonable adjustment' of time, to accommodate those with disabilities as per their legal right.
    UKPC, as well as the landowner, BP Investment Management Ltd, and yourselves as their agents, are jointly and severally liable for the indirect discrimination caused by UKPC.

    I ask for your cooperation on getting UKPC to cancel this discriminatory parking charge. For reference the Parking Charge Reference Number is XXXXXXXX.

    I've not yet appealed using the template response, should I do so or has it gone past that point now?

     You can appeal by day 28, as the PCN already tells you. Use the same robust stuff you said to ESH.

  • ESH have responded stating that they were simply the letting agents for the retail park and therefore are unable to help, but they did provide the email address of someone at JLL who may be able to, so forwarded on the email to them.

    Add that you are also complaining to JLL who are known to cancel PCNs and have a fair understanding of the 'market failure' within the parking industry that you are certain UKPC are keen to distance themselves from. Failing that you will get it in the INSERT NAME OF LOCAL PAPER and contact your MP (name them).

UKPC, as well as the landowner, Jones Lang LaSalle (JLL), are jointly and severally liable for the indirect discrimination caused by yourselves with the issuing of this ‘charge’.

    JLL have been contacted regarding this incident, and are known to cancel PCNs and have a fair understanding of the 'market failure' within the parking industry that I am certain that UKPC are keen to distance themselves from.

    If UKPC continues to pursue this unenforceable and discriminatory 'parking charge', then information regarding this will be sent to local news media including the Somerset County Gazette, as well as to the Member of Parliament for Taunton Deane Rebecca Pow.




  • I did get a response back from JLL today that they'll put in the request for it to be reversed, but it's the discretion of the parking company. Hopefully the relevant department there will put it through as an actual cancellation request as UKPCs client rather than simply 'kindly asking'. But happy to get a positive response nevertheless.

    In the meantime I presume I should get the appeal submitted before the 28 day deadline, is the above ok?
