    she has never been in receipt of carers allowance, I was misinformed by SWMBO. It was paid to my late FIL 

    For whom was he caring? You said that your MIL didn't start to receive PIP until 2018 and he died in 2017.

    Was he in receipt of some other benefit?

    OP - did your MIL reach SPA in the new system (on or after 5/4/16) while your FIL reached it in the old (on or earlier than 5/4/16)?

    • Where the contributor reached SPA or died in the old system and the dependant reached SPA in the nSP. The basic principle is that the dependant is entitled to an inherited amount equivalent to what they would have been entitled to had the old system had continued. 


    Was your FIL entitled to a high Additional State Pension? SERPS/S2P/GRAD?

    If so, is it possible that £4476 is ASP inherited from her late husband?

    Do you have sight of your MIL's SP increase letter which she would have received in around March this year?

    Is she actually receiving SP of £10,581 plus  £4476 per annum?

    That is to say  weekly NSP of £203.48 NSP in her own right plus inherited ASP of £86.07 a week?
    As I understand it my FIL claimed CA because MIL was looking after him. He had a genetic life limiting disorder. I have checked her pension increase letter and it is only for the basic SP there is no additional pension on it i.e. £815.40 every 4 weeks.

    It says State pension, in brackets, after the word Benefit.

    That was my thought too. It seems to be the full new state pension as the main state pension deduction and then the other state pension deduction is the inherited part from her late husband. Seems odd to separate it out as mine isn’t but perhaps they do it that way if it changes after you’ve reached SPA. 

    Perhaps the OP can check exactly how much state pension his MIL receives and see if it tallies?
  • Having spoken with HMRC this morning, after being on hold for 30 mins, MIL is to receive a refund of over £1500 as it was PIP that was being taken as a taxable benefit. That has now been removed and a new coding notice is being sent out. Speaking with MIL she was getting carers allowance for FIL. Not FIL claiming it. More duff info from SWMBO! HMRC hadn’t changed it despite having been told on more than one occasion! Thanks everyone
