my tesco credit card debt response( and many others) today

hi continuing my cca letter response i got, i went on to my tesco bank account online looking for an email address to explain my repayment plan. I only found a phone number, a live chat or a postal address. ( could not find an email address)

 I started live chat  thanking them for my credit agreement and said i will make  a standing order of £20 on the 28 november and there after every month.

The woman said we can only accept if you fill in our income and expenditure form, i refused, she said she will put my account on hold for 7 days until i fill in the form, and psot me a letter.
 she said it is to stop me overpaying too much in a plan., she said further action will be taken if i dont fill in the income and expenditure sheet, I said i wont fill it in, please sell my debt on if you like.
 i said goodbye to her,  and ended the chat.

I then went on to my bank and set up a SO, the only thing is my bank couldnt verify the account, as i put in tesco and their sort code, account number and my credit card  debt number, (it came up tesco personal finance plc in the sort code number section, autofilled in  by RBS). but it couldnt verify the account?
 i got all the details from the how to pay which was in the back of the original credit agreement they sent me.
anyway i set it up..

i then  went back on to tesco bank online at how to pay manually and it only showed pay now with your debit card, it then said, how much ? where are the funds coming from? do you owe any other creditors?, are you behind with any priority debts?,  fill in our income and expenditure sheet! before it would let you make a payment
  so i left it and hope my SO goes smoothly, despite RBS saying it is an unverified account, and tesco actually get the money monthly, i typed it all in correctly, just the name Tesco, that was the only business name i could think, it then showed tesco personal finance plc next to the sort code, in the RBS SO set up.
 so i assume it is actually tesco business account. never heard or seen that response before. also hope Tesco dont try any further action cos i wont fill in their income/expenditure form

I also emailed stepchange saying bye bye to them that i will manage it on my own.

I am now thinking Tesco won't accept my plan without the form filled in or the standing order is dodgy in some way as  the end of SO application RBS said as this is an unverified payee we can't be held responsible for money going to a potentially fraudulent  unverified payee.

I thought leaving stepchange and going on my own would be super simple.but that is already 2 snags and it's only my first creditor .

  • i would definitely drop step change and do it yourself. i would also refuse to do an income/expenditure form. tell them how much you will pay and they can take it or leave it.

    They give some bank details here. If that's the account you used then the warning is probably just because the name didn't match.

    I'd send them a letter telling them what you are paying and to where, and ask them to supply alternative account details if they want it sent somewhere else.

    that is sort code and account number I used.dont want the hassle of going to post office again  and doing recorded delivery.so I  used their live chat today instead to explain my plan.thr replies I gave to the lady were firm,short and to the point.i never backed down to her demands.
    I'm really unsure what happens next.cos it was odd how those in arrears, it won't even  allow  a manual debit card payment on their site without a  sao form or it won't proceed to payment page

    or agreeing to use  a standing order wanting sao also. it's this phrase "we need to make sure your not paying too much" that the live help lady said.
     I wonder if they will take my monthly payments  and  end it with that or they will somehow take more action whilst at same time taking my SO payment or even return my monthly payments.

    what could happen if I don't fill in their forms but they collect my payment anyway and I fall into more hardship and then Tesco get into trouble cos the let the plan go ahead even if refused to fill in their SAO form. I can see where their coming from if I pay too much.but I think it's for them to check I'm not paying too little or is that just my suspicions.

    but tbh I said to them I know the law im not filling in your form,sell my debt on if you're not happy.

      and Rob ,can you take a look at my thread I did yesterday about this CCA response and have a look at some points or questions I raised thanks.

    How kind of them to be so concerned about your outgoings...I'd be strongly inclined to thank them for their concern, but that you have a good control on your budget now so you are confident in knowing that your proposed payments are affordable to you. 

    I bet they weren't so "concerned" when they were raking in the interest on the debt though!

    They are just covering their **** really, so you can't turn round later and say they made things unaffordable for you. I had the same with Link, they grumbled at first and then sent me a letter saying they wanted to make it clear they were only accepting payments on a concessionary basis as I hadn't sent income/expenditure forms, or words to that effect. Again just **** covering.

    Don't worry about it, they'll get the payments and if they don't like it that can sell it to someone else.

    I did tell her I can create and manage my own plan.she said post us your plan and we will check it over for you!!! and agree or not to it.
     so what will happen now.i feel as if I should never had contacted them today and just set up a SO via my bank.
    I thought well they say if you ignore their letters etc that's when they take that sort of folk to court. so I responded like a considerate person 

    oh.postman just been.wife got her Tesco debt 1pm special delivery signed for.but postie's just put it through door.he never knocked. and he missed the 1pm deadline.hes away now. hmm gives wife ammo to say  to Tesco bank ,you never sent a CCA agreement as  requested,if postie's just stuck it through letter box and walked away.an important signed for letter!!!!

    plus got PRA reply. we have placed your account on hold until we get all the info requested. and will stop any further letters to you until we get the info you requested.and we return your £1 as we don't charge you for our service.

    plus postie gave me a capital one response.it reads, below is the most up to date  info that we can provide ,current balance min payment date of last payment amount of last payment account open date arrears interest rate for purchases cash transfers and date of default.

    it is simply a short letter .it is not a copy of the credit agreement but a selection of important bits they have picked and wrote in a short letter.
    they have not stated if it's enforceable or not.nor have they sent a history of transactions as I requested that too along side a copy of CCA.

    . BUT they say at end of letter if you have requested copy of credit agreement .copy of default notice or statements.they will come in a separate letter. this letter today is for info only.
    ps capital one card was never sold on.its still with capital one and collected by capital one.
