Intrum Uk. Unable to provide My CCA agreement. Advice Needed please.

Hello eveyone, i would be so very grateful for any advice on this matter please.

I have a debt with a Debt Collection Agency called Intrum UK. The debt is for £3300 for a credit card with the HFC Bank dating back to 2005/6. The debt seems to have been bought several times over by different debt collection agencies over the years and Intrum UK now have it.

I have been paying this debt at £20 per month in a payment plan with them for many years.
On the 7th of September 2023 I  requested By recorded delivery, a CCA Request for the debt.

Today i received a reply from them dated the 1/11/23. Their letter states that they have contacted HFC bank  'who are currently unable to provide them this documentation and although the balance remains outstanding, we accept we are not pemitted to take enforcement action against you whilst this request remains unfulfilled'. 


The letter then goes on to state that my next *£20 payment to them is due on the 24/11/23 by direct debit and to provide a budget statement to them.


*Note; I have still been paying this direct debit of £20 every month whilst i waited for them to provide ther CCA , even though they said they would suspend the payments whilst they searched for the documentation. They did not.

My question is, should i stop the Direct debit and wait for them to contact me with a settlement offer, or just ignore any of the inevitable  letters they will send me when i stop the direct debit as they cannot enforce payment.

    I'd stop paying and ignore them completeley as they can't take any action against you now. It's unlikely they'll ever produce a CCA for an account that old that has been sold several times. They always say "currently unable to provide" to encourage you to pay by making you think they may be able to provide it later.

    Cancel the DD. Ignore any settlement letter unless they've produced the CCA. The only thing about which you need to take advice is if they say they've sent a CCA, as much of the time they haven't.

    At this point, you might want to put that £20 into an emergency or fighting fund. If they do find the CCA, you could try  10% offer.

  • Thank you Rob and Ras for your good advice. I'm always very nervous with matters like this and its wonderful that i can get sound advice here. I will continue to put that £20 away per month also. 

    I was going to cancel the Direct Debit after the next collection due on the 24/11/23, as that will be 3 whole monthly payments made since i made the CCA request, but i'm inclined to cancel it now following on from your advice.

    Yes - now they have confirmed it's unenforceable don't pay a penny more.

    Always come back here if you are unsure of anything, lots of us have been in similar positions and have gone through the same process. 

    They are still entitled to ask to pay, but they can't take any legal action if you don't now. You'll probably get letters asking you to pay, offering "special" discounts, saying they can work with to clear them, and possibly phone calls too. Just ignore them all and block their number.  I have an unenforcable debt with PRA and they offer me a 20% discount that expires in three weeks, then when the three weeks is up they offer me another one a week later. They've done it about 15 times so far which shows how desperate they are.
