We've teamed up with Boots this Christmas, and we want to encourage you to Give Joy to the givers in your life. We're on the hunt for your nominations of the people who always spark a little joy in everyday life. Maybe they go above and beyond or are simply one of the good guys.     Boots Christmas Promotion on the Heart Network, November-December 2023 – Specific Rules 1.     The Boots Christmas promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Monday 6th November 2023 to Monday 25th December 2023 on the Heart Network. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Boots and the ‘Prize Provider’ is NDL. 2.     IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. Details of the Promotion: 3.     To enter the Promotion, you must:  (i) go online to the Promotion entry page at heart.co.uk/win and register your details;  (ii) explain in 500 characters or less who brings joy to your life and why, and what would make their Christmas extra special (your ‘Submission’).  4.    There will be 5 winners across the Promotion. 4 will be selected via a judging process and the 5th winner will be selected at random. 5.    Online entry will open on 17:00 on Monday 6th November 2023 and close at 23:59 on Monday 25th December 2023. Entries received before or after this time will not be included in the Promotion. 6.    Any listener submitting a nomination (the ‘Nominator’) must have obtained permission from the person they are nominating (the ‘Nominee’) prior to entering.  7.     If it’s found that the Nominee selected to win did not give consent to taking part in the Promotion, that entry will be excluded and another one selected.  Judging process: 8.    Entries for the first 4 winners will be judged by a panel of judges including one independent judge on the following criteria:  a) how entertaining the Submission is;  b) how unique the Submission is;  c) how family orientated the Submission is and  d) how achievable it is to create a bespoke prize package 9.    Entries deemed by us to be rude, offensive, defamatory, illegal or condoning dangerous behaviour will be removed from the Promotion. 10. The judging sessions will happen on the following dates:                         I.First judging session: Monday 13th November 2023                       II.Second judging session: Monday 27th November 2023 11. On each of these dates we will randomly select 60 entries and these will be reviewed by the judges against the criteria outlined above. Two entries per judging session will be selected as winners.  12. If none of the shortlisted 60 entries are deemed to meet the stated criteria, another 60 entries will be drawn at random and will be judged against the above criteria.   13. The four winning entrants as selected by the judging panel will be contacted by one of our representatives via telephone on the telephone number with which they registered to enter the Promotion. If such winner does not respond within 3 attempts to contact them they will forfeit their right to the prize and we shall be entitled to select another winner from the list of 60 judged entries. 14. The winning Nominators will be required to help us surprise their Nominees via video call, the details of which will be discussed when Heart make contact with each winning entrant. Heart Breakfast will surprise the Nominee and invite them to partake in an on-air moment, to be awarded their prize. Thus the Nominee’s voice and image, name, and nearest geographical location (for example, nearest city, town or county) will be broadcast in the Heart Breakfast Show and on Heart’s social media channels.  15.  If you are a Nominator or a Nominee and we call you, your call may be recorded for our records and/or could be broadcast live or pre-recorded for future broadcast. You must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. 16. In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. Random draw winner: 17.  Within 14 days of the closing time of the Promotion, all eligible Submissions received during the Promotion period will be entered into a draw. One entry will be selected at random and the winning entrant will be contacted by one of our representatives via telephone on the telephone number with which they registered to enter the Promotion. If such winner does not respond within 7 days from being contacted, they and their Nominee will forfeit their right to the prize and we shall be entitled to select another winner by another random draw. That subsequent winner must respond to the notification email within 7 days of the date on which they are notified, or they will also forfeit the prize. Use of Submissions on-air: 18. Your Submission may be used in radio advertisements (“Radio Ads”) and/or on Outdoor advertisements as part of the Promotion Partner’s marketing campaign. These Radio Ads will be created by our creative agency, Global Creative and will run across the Heart Network. The Radio Ads may also feature online at  www.heart.co.uk for as long as we consider appropriate or desirable. The details in the Submissions selected to be used in the Radio Ads may be changed to feature a fictitious name and/or location, where appropriate, but anonymity cannot be guaranteed.   19. You may be contacted by us to discuss your Submission as part of this proposed marketing campaign. 20. If your Submission is used this does not mean you are a winner of the Promotion. 21. For the avoidance of doubt, any Submissions used in the Radio Ads will be used freely by Global Creative and entrants will not be paid for any content contribution.  Eligibility: 22. The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry. 23. Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion. 24.  An entrant can only win once during this Promotion. Prize:  25.  The 4 x judged entry Nominators will each receive:  A.    £500 Boots e-gift card 26.  The 4 x judged entry Nominees will each receive:  A.    A bespoke prize/experience based on and tailor-made to the Submission, where possible, up to a maximum value of £2,000.  B.    £500 Boots e-gift card.  27. The x1 winner selected from the random draw (the Nominator) will win a £1000 Boots e-gift card. 28. The winners’ Submissions and the Nominee’s contact details will be shared with the Prize Provider to enable the fulfilment of the bespoke prize/experience.  29. Gift cards should be treated like cash. Lost or stolen cards cannot be replaced. Please note this card is not a cheque guarantee, credit or charge card and no interest is paid on card balances. Gift card will expire after 12 months. You will not be able to use this card after that date and any unused balance on the card will be lost. For security reasons, cards are delivered unloaded, card will automatically load within 48 hours from delivery. Winner will be required to open a Boots account in their own name to shop online. Gift cards can be used both online and in-store.  30. All prizes will be delivered within 28 working days from the date that the Prize Provider receives confirmation of the delivery addresses from the winner. The Prize Provider will do their best to adhere to these time frames, however there may be delays with stock availability and deliveries. 31. Clauses 30-34 (inclusive) are relevant if the bespoke prize package is a holiday or involves travelling, save for Clause 33 which applies to all prizes. You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.  32. You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.  33. You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).   34. If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions. In accordance with Clause 38 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 35. Travel insurance will be provided by the Prize Provider and is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. No age restrictions apply. Should the Prize Provider be unable to purchase travel insurance on the winner’s behalf, a cash fund of £25 per person will be allocated for travel insurance and will be provided to the winner via bank transfer. Should this be the case it will be the sole responsibility of the winner to obtain suitable travel insurance for themselves and, where applicable, their guests. 36.  Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner.  37. The prize is non-transferable and non-refundable and no cash alternative is available except in our sole discretion. 38. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 39. Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) and our Promotion Partner as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion.
