Will do, thank you, and thanks for the CTSI steer. I’ve just finished watching the channel 5 documentary, Parking: The Big Con (nice to meet you!) and would like to know what the case was that concerned the very talented plasterer, Chris. What/which case is his?0

I was the lay rep for Chris' case and as you saw, I was on that TV programme too. Yes, nice to meet you too - for newbies, I'm the lady interviewed on Shoreham beach in that show. Bargepole of this forum parish is the guy at his kitchen table. He is legally qualified and does a lot more cases than me.Luccathedog said:Will do, thank you, and thanks for the CTSI steer. The case with Chris was Britannia v Crosby and he is a nice honest guy - and it was great while it lasted. But it no longer holds water.
On the day, I beat an Oxford-educated barrister hands down at Southampton Court. Loved that case... except for one thing:
There were six named Defendants. No-one else turned up (because it was Britannia's application objecting to a strike out order so Defendant's didn't have to attend) except for one arrogant guy who turned up at the last minute, spouting Freeman of the Land rubbish and he had zero defence.
He sat there as an onlooker but said a couple of things that gave him away as having no idea what was happening and he wasn't sitting with us, so the barrister could clearly see he would have been a victim for the taking, had we not rocked up.
Guess which defendant's case Britannia appealed?
Yep. Not Chris Crosby's case. The other one.
Mr Crosby knew nothing about it and seems in the TV programme to think the case is still usable/relevant.
But sadly it isn't, due to the Britannia v Semark-Jullien appeal where we only found out about it afterwards, and they'd clearly walked all over "Mr FOTL". They got a credulous Circuit Judge to reverse DJ Grand's correct judgment which had relied on the Consumer Rights Act 2015 (my favourite legislation for parking cases).
Ho hum!
You can find the reports on this forum but it can't be used now.
More important to me now, is my work on the DLUHC Steering Group. This is going to be real change when we finally get the statutory Code over the line in 2024.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

How very frustrating and predictably opportunistic of them. Thanks for the other information. All very helpful. Keep up the sterling work and I sincerely hope the burden on you guys eases and the easy money for the unscrupulous becomes so much harder from next year.1

You might find this SDT decision interesting:

Until a few years ago, the IAS and Gladstones had the same two directors.1 -
Oh look, @Luccathedog -
the broken link is mended.
A new 2023 'Report' has popped up:
https://www.theias.org/
Don't get excited. IMHO, this is a joke. This new IAS Activity Report tells us nothing useful whatsoever. AOS members dropped 6000+ cases and apparently the IAS Chief Adjudicator has not seen any significant trends (at all) in the 19k disputes between traders & consumers the IAS 'adjudicated'.
Despite the fact that the private parking industry has been said by Government to be in 'market failure', old Bryn whatsisname has noted nothing that traders can improve on, apparently. Nothing that could assist the new Single Appeals Service or Scrutiny Board to understand likely trends or to drive up standards? Nope.
Unlike their previous woefully embarrassing stats (average 5% appeals were upheld across 3 years) this time we are shown no stats at all, re how many futile appeals were upheld. I can count on one hand how many anonymously 'adjudicated' IAS cases I know of that were decided & won this year, and two of those were won by a BMPA member.Maybe there is a separate statistics document to follow? Won't be holding my breath.
In other news, @ParkingMad spotted this new Ltd company registered this Summer by the person who runs the IPC.
I wonder why, given (surely) that the IAS is being replaced and confined to history?Nice try...

Well, we're now at the end of this ridiculous saga and I have today learned from calling the Court that the Claimant has discontinued proceedings, on the very day they received my WS, last week. Their letter informing me of the same never arrived. Happily the Court obliged and sent me a copy of what they had been sent.
I'm so glad I called the Court to enquire if they had received a copy of the Claimant's WS (as I had not and we're past the deadline) otherwise I could've been rocking up to the Court at the end of this month for a case that is no more.
My thanks to the sterling work that so many forumites do here in the fight against unscrupulous parking industry operators.
May the Force!
EDIT: And apologies to @Coupon-mad, I didn’t see your above November post till yesterday 19 July 2024. I’m not a regular here but appreciate what you’re doing. All the best!7 -

Similarly, my apologies that I didn't stumble across this outcome until today. Yay - well done!
