Are taxes refundable on a returned item?

    Below this line on the terms and conditions it states - "However, any additional costs resulting from the choice of a particular delivery method other than the least expensive type of standard delivery offered by the Owner, will not be reimbursed." And at the bottom it also confirmed "The costs of returning the goods are borne by the User." Our returns policy confirms we will deduct £4 from the cost of your refund if our label is used to send this back to us.
     
    As this is the case when returning an item to us, if you use your own method of return you will receive the full amount of your item. However if our label is used £4 will be deducted to make your total refund £15.95. 
     
    I apologise if this is not the outcome you desired.
    As expected, it has nothing to do with the taxes. They're charging / retaining the charge for:
    1. Full cost of outward shipping £4.95
    2. Protect my order £0.99
    3. Return shipping label £4

    No 1 should only be the excess above standard - what was the "least expensive type of standard delivery offered"?
    No 2 dunno, depends on what this is
    No 3 You are responsible for something for this, but were you told what the cost would be before initiating the return?

    It appears 2 is for you to have your statutory rights... refund or replacement if the item is stolen/lost in delivery process, damaged or delivered to the wrong address etc. Only thing it arguably does is maybe accelerate payout/resolution.

     you paid £19.95 for coat plus £4.95 postage.  

    you are due a refund of £ 19.95 plus standard delivery postage, less £4 for return postage.

    How much was standard delivery?

    They have deducted £4 for refund postage  but also £4.95 delivery postage.

    This. Retaining the £4 is allowed* under the Consumer Contracts Regulations, as they state that the cost of returning the item to them is your responsibility. The refund due would be £20.90 therefore, and they are in breach of the Regulation 34 (2) by retaining the additional £4.95.

    *If it was not made clear in advance that £4 was the cost of their label / you were responsible for the cost of returning the goods, they are also in breach of Regulation 35 (5) (b) by deducting that sum.

    Following my less than favourable review on reviews.io I have received a refund of £4 for the postage cost of returning the coat. I have emailed Hollands to thank them and quoted them the Consumer Contracts Regulations 2013, Part 3, Regulation 34 (2) regarding the original £4.95 delivery cost.
