Item missing from online delivery

I ordered £450 of perfume/aftershave from the Perfume shop online. When the postman delivered it he said to me ‘be careful the box is a little worse for wear’ (or something similar)

anyway when I opened it, it had an £84 bottle of perfume missing, I contacted the retailer straight away, sent photos etc. long and short of it they have said it was packed correctly at the factory and Royal Mail told them it wasn’t tampered with in transit (no idea how royal Mail would know that)

so they’ve declined to help any further! I’m absolutely gobsmacked. Have I got any recourse against the retailer? It can’t be right That I simply lose an £84 item through zero fault of my own!

    Was the box worse for wear? Could it have fallen out of any damage? 

    Personally I would refuse delivery of any damaged parcel, especially as these days you often don't get the opportunity to sign to then note it as "damaged" 
  • Always always always take a photo of any damaged packaging before opening.  Even better take a video of you opening it.  You hear so many cases of people buying expensive items and when they open the box it's empty.  I make it routine now to take photos of the packaging and take a video of opening it
  • No but I was kind of ‘floppy’ is the only way I can describe it! I can only assume it was opened in transit and an item stolen. I had 4 boxes delivered in one go and this was at the bottom of the pile when he handed it over to me. So it wasn’t like obviously damaged. He just said to me to be careful when he passed it to me but more of a ‘this box is a bit iffy so be careful you don’t drop it when I hand it over’ kind of thing 

    anyway regardless of all that, im still missing an expensive item.do I have any consumer rights here ?

    if it had been opened there could be some indication of resealing it.  


  • Possibly but I didn’t notice. Didn’t cross my mind at the time. I just assumed that the missing item was going to be delivered another day  in a separate parcel and that was my starting point with the retailer when I first contacted them 
  • This is what the box looked like after I opened it.. I opened it at the top, as u can see. No obvious evidence of it being damaged prior to me opening it. It just felt Slightly ‘floppy’ (Almost like it had maybe got a bit damp in transit). Certainly nothing glaringly obvious

    As a genuine question was £450 on perfume (and other boxes whatever they contained) a purely personal purchase i.e. qualifying for consumer rights or part of a business/for resale ?

    They had a buy one get one half price offer. So I basically brought half a dozen items to give as Xmas presents to family members as their main gift.
