Amazon return third party seller

    So they both went to an Amazon returns warehouse. The  question is what have that Amazon returns warehouse done with the item that should not have gone to them ?

    They may have sent it on to the correct warehouse. In which case you will have to wait until it filters through the system. 

    The other possibility is that people have reported that  if it is a higher value item these are checked before refunding and  can  takes up to 60 days. 

    Is there anything noted on your order history for that item?

    I’ve asked what has happened to the item. I included both return notes in the box so all traceable details were with the product. Someone must have done something with it!

    Amazon have said they don’t know and can’t help. 

    There’s nothing noted on my order history for that item. 

    They told me only one item must have been received but this is not true. They were both in the box. I even took a photo of it!

    When I get to this point in my conversations with Amazon either by chat or phone they say they can’t help and end the call/chat. Well actually they hang up! I’ve never known customer service like it! And this is following on from multiple people about 3 weeks ago confirming I will receive a refund from Amazon as seller won’t refund me. 

    I even asked the seller for help multiple times trying to resolve this, as I assumed they would have business contacts at Amazon, and because they have stock at that premises,  but they just said no.

    Sorry Sheramber, that reminded me- before today when multiple customer service people told me no refund, the last customer service person I spoke to at start of Oct said I would definitely be refunded and he could see it on the system. He said wait until 27th Oct and contact again, which is what I did today where multiple staff told me that the different people I spoke to at start of Oct who confirmed I would have a refund (and this was multiple people over multiple days) were all wrong. 
  • Sadly, I think you are left waiting to see if the item turns up and is attributed to you.  Given the time elapsed and the millions of parcels Amazon send every week from their warehouses, the chance of that happening is slim.

    I don't see any other way of you getting a refund.

    I would think you’d need to check Amazon’s terms and conditions - if they have no mention of Amazon having the right to dispose of any items sent to them in error, then it’s an easy win (but they may still refuse to pay until a court forced them to, and can choose to suspend your account if they wished - they’re not obligated to accept future business from anyone and aren’t breaking any laws unless their refusal is due to a protected characteristic (race, disability, religion.) 

    If their terms do state that by sending an item to them, you accept that they can dispose of rather than retain/return a wrong item, you’d need to first get a court to strike that term out as an unfair contract term. After all, if they sent you a wrong item, you’d be charged for it if it wasn’t returned; you legally have to make it available for them.

    The seller doesn’t legally have to do anything - the error wasn’t of their making and they don’t have their item, so would be out of pocket if they refunded you. It’s lacking in Customer Service that they haven’t even tried to get Amazon to return the item to one or other of you at your cost, but they’re under no obligation to do so.

    That will be the item that should have gone to Amazon at a guess. Not the one that should not.
