Refund due or not

Recently purchased Hair Dryer at Argos.  Box carried Sticker "Do Not Open Unless You Wish to Keep" . I had to open it at home to judge whether it was okay.  However, the barrel of the Dryer was too big to handle and I returned same, all intact, but told no refund as I had opened the sticker. I explained I had to open box to physically examine the dryer and attachments and did not realise the dryer section would be so big. I was told I should have read up the description on line which I did.  I realised most of the attachments would not suit me but I knew the smaller brush would be fine so I was fully prepared to accept that.  However, I had no idea how large (Width and Length) the actual dryer part would be and it was unsuitable for me. Can I insist on a refund or not, bearing in mind it cost £50.00

    As you purchased in store you have no right to a refund unless it is faulty (which it isn't).

    You can ask to view the products in store for future reference. 
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    Fitbit publish full measurements for all their products, including what wrist circumference is suitable for the different sizes of strap, you only need to measure your wrist to know.

    And shoes have sizes on them too.  Doesn't mean they are going to fit or be comfortable.  Sometimes trying something is the only way to know.

    Mine came with two different straps so they fit all sizes of wrists! And the dimensions are on their website.

    (I do like my Fitbit, but it clocks lots of unnecessary steps, even when I play the piano!! My Samsung was far more accurate!)

    Your opportunity to view the item is in store, before purchasing. If they refuse, then your remedy is to shop elsewhere.

    I suspect the retailer has had to implement this policy die to the number of fakes in the market. It would hopefully prevent someone switching products.
  • It depends on how the OP ordered though. If they ordered online to collect in store, then it would be a distance sale and they would be entitled to cancel the contract and return.

    If it was purchased in store and taken away at the same time, then no, there is no automatic right to a refund for a change of mind.

    As above, you have no consumer right to a change of mind refund so you were left with Argos's own 30 day returns policy.

    The Terms and Conditions for this policy include,

    Your item(s) needs to be:
    • Unused and with all original components
    • In its original packaging (with the tags if applicable)
    • In a resaleable condition security seals intact (where applicable)
