next step to take

I received a PCN which i have gone through the appeals process. i got it for pulling into Private land in an emergency, and was in there for a very short time, while i sorted the issue out. i have now received a letter of claim, and not sure what step to take, i feel strongly  I had no option but to pull in where I did, in fact never even thought about it, until I received the initial notice. have done all the appeals, asked for a SAR request, which I havent had from any of the companies That it has been passed through, except the legal company it has now passed to. Is it Time to give up, or is there anything else I can do

Name of parking firm? Name of legal firm?

After response to those, please read the NEWBIES FAQ Announcement, second post, which will point you in the right direction for dealing with a Letter of Claim. Have you contacted the landowner to ask if they will intervene and get this cancelled over such a short stop in an emergency. Out of interest - what was the emergency, and exactly how long was the stop for?

Always stop on a public road, never private land, whenever possible. It's what yellow lines are for.

    Which PPC?
Where did the alleged event occur? It may have cropped up here before.

What happened when you enacted Plan A, a complaint to the landowner and your MP?

Read the guide to court written by bargepole that you will find in the second post of the sticky Announcement for NEWBIES in conjunction with the template defence sticky Announcement that includes a twelve step guide to court.

If you want more time, tell the claimant that whilst you deny the debt, you are seeking debt advice and require the case to be put on hold for 30 days as per court pre-action protocol. Do this near the end of the 30 day deadline given on the Letter of/before Claim.

  • I was light on details as I didnt know whether the companies read these posts, but to add to the comments the parking company is UKPC and the legals DCB. The length of stop was 20 mins and I had Malfunction in the car. I never left the vehicle to go anywhere. I contacted the landowner to explain and got no joy, I did the bit about Debt advice and got the 30 Day extension. it was in a closed fast food car park. I also had no chance to pay the 1st invoice as i was out of the country and the time lapsed while I was away.
  • trying to help myself, but cant find any of the posts suggested, sorry not very competent with this, any advise what to type in the search appreciated
  • please ignore last post now found them, and reading through.

A little more - and encouraging - reading for you. As this is a UKPC/DCB Legal combination, outlook is especially positive. Keep following the full process and this should be off your back some time next year. Most of the work you need to do is included in the NEWBIES FAQ Announcement, second post, and Template Defence Announcement.

  • another issue I think I may have is the timeline, my 30 days are up in the middle of the month, what sort of timescale would the next steps take from the legals, because I will be out of the country for about 10 weeks from the end of November. afraid things may get sent to my house and will not be able to respond, can I state I want everything emailing to me

    Please confirm the above answer?

And what letter did you get from DCB and was it DCB ltd or DCB Legal?

If it was a LBC from DCBLegal please give us a timeline:

    Date of LBC?

    Date you replied?

Date they extended it to if you asked for 30 days hold (which you should never have done, if you knew you'd be away from November),

Surely someone can get and open your mail?
