DFS - warning

Fault reported within 24hrs of delivery. 5 months later I am still waiting for them to collect it and refund the cost. They are trying to bully me, a pensioner, into accepting a repaired chair. I am days away from the Small Claims Court.

I am days away from the Small Claims Court.You need to formerly reject the goods under the (consumer rights act 2015) which it appears you have done.For a fault in the first 30 days, you have to prove the item is faulty, you can provide photos/video and if they will not accept these and offer to send someone, do not agree, even if it is a 3rd party because we have found that such 3rd parties have ongoing contracts with the supplier and are not unbiased.Simply say that if they do not accept your evidence you will get your own expert report and in accordance with the Consumer Rights Act (2015) add the cost of the expert report to your claim.The Consumer Rights Act (2015) also says that Consumers should not be inconvenienced, nobody could argue that 5 months has not been an inconvenience. So I would be writing to them explaining that you are charging them £75 a month for storage of the chair, I have done this with companies and they settled in full when I sent a formal letter of claim before action in accordance with Practice Direction for Pre-Claims.You can also had an interest charge at Bank of England base rate plus 8%, it is not much but it all adds up.You rejected the goods within 30 days, so you are not obliged to accept a repair, it is that simple.If you had rejected between 30 days and 6 months it would be different and if you had rejected after 6 months it would be different again.DFS appear on BBC Consumer show with alarming regularity, mind you so to SCS and more recently Sofology.Furniture is really poorly made these days, suppliers make up all kinds of BS like telling you that you have an obligation to plump up cushions (even those sewn in) which if not made prominent at point of sale are void).Honestly you will find better furniture on Freecycle and even if you pay for it to be reupholstered it will be of better quality and last longer.0
