Missed witness statement

Hi all,

My court date is next week and I did not know I had to send a witness statement -- the newbies FAQ said the hearing letter should set out a deadline for that but my letter said NOTHING about it!!

Should I send a statement ASAP and try to justify it as the letter never having said anything and I did not know I needed to send one (which is true)?

Hello and welcome.

Look again at your Notice of Allocation. The Notice that gives the hearing date.

Is there not a paragraph something like:

Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].

Might be on the back.

Those 'documents on which you intend to rely' are your Witness Statement and evidence.

Hi @KeithP, I got a "Notice of Small Claims Hearing" giving me the date, which does not say anything of the sort.

Yes but the previous letter - the NoA - did.

You need to email it tonight. I wish you'd simply done it today instead of posting here. Receiving their bundle also gave you the red flag & clue you needed, earlier this month, that the time had come for WS.

Do the bundle now. Email it tonight to the LOCAL court (not Northampton CCBC) and the solicitors.
