DCB Legal Court Proceedings

I've been trying to avoid creating a new thread here and trying to use the forums available to me but I'm recently diagnosed with ADHD and it's kicking my butt over this issue so I'm worried about missing deadlines as I keep putting it off and I'm struggling to find information relevant to the specifics of my case in the threads.

In 2017 I got a parking ticket parking in a clinic, as the clinic I intended to go to was one I regularly attended that had just moved, and I got a satnav to where it had relocated to and parked at the place I saw labelled 'clinic', but it didn't end up being the right one. I went into the correct clinic as it was a 3 min walk from where I parked, and came back to a ticket. I didn't even realise about the parking restrictions.

They've spammed me with mail ever since and then, this year, I got a letter of claim from them and then a claim form. I've been ignoring as I thought that was the advice, from a long time ago, but I think that has changed now. So once I got the claim form I came back on here and went through the forums.

I did my acknowledgement of service or whatever it was, and my SAR, admittedly I believe I missed the deadline slightly (avoidance of anything admin-related is my superpower). I put in the letter provided on here as a template, that I have no memory of what happened really because it was 6 years ago.

On receipt of the evidence of my contravention I was pretty hopeful as I can see my car just in a space, and the sign says 'no unauthorised parking'. I figured this is good for me as you cannot see that the sign was in view of my car (I think this came up in the threads) although the sign is not obscured in the photo of it, and what is 'unauthorised parking' anyway? It doesn't specify, and who's to say I wasn't attending that clinic? Surely that would be authorised and then how can anyone prove I wasn't attending there?

Anyway I figured I could argue on those bases, and told them I'm happy for it to go to court. They have since confirmed they would like to proceed and that's scaring me and making me think perhaps I myself don't have a leg to stand on. The anxiety is too much now for me to try and decipher the multiple threads and so I'd like some advice on what to do next please.

I received the email confirming they are proceeding with the claim on 06/10/2023, and haven't had anything from the court just yet. It's been very tempting to pay it because this is so much work, but it's the principle I guess, the experience to be able to take to other people experiencing the same thing that may be more vulnerable, and the fact they have hiked the price so much to include legal fees, interest, whatever.

    Sorry to say that you could have stopped this claim completely by replying (one email) to the LBC and getting it past 6 years.  They could not have filed the claim.

    Too late now...

    ...but easy to defend.

    What do you need to know that's not already in the second post of the NEWBIES thread and the Template Defence?

    What did your defence say exactly?

    DCBL love these rububish cases, the courts DO NOT because it's just timewasting to which DCBL are now famous for ?

    Even if you receive a claim, it's 99% that this will happen ....

    06/10/2017. What could I have said to get it past 6 years?

    Yeah I was just checking that my argument is the right angle to take, that the sign is not in the images of my car so they cannot prove that it was visible, and that the sign just says 'unauthorised parking' which is very non-specific and so there is no evidence that I breached any terms. And perhaps that they cannot prove that I was not a patient of that specific clinic and therefore that my parking was unauthorised at all?

    I used the template and where we were to insert our own specifics (I believe only in one place) I put:

    "3. The defendant parked at the site in order to use the clinic. There were no clear parking restrictions to the defendant’s recollection, nor were there any machines at which to pay for parking, per the defendant’s recollection. Due to the passing of many years since the event, the defendant is unable to recall details."

    • Defence completed
    • Hearing date given
    • Witness Statement deadline dictated by the court
    • Phone call from DCB Legal to defendant
    • Email to defendant from DCB Legal with 'Without Prejudice Offer to Settle'
    • If no response from/refusal by defendant, email from DCB Legal - 'Notification of Discontinuation' 
    • Confirmation of discontinuation from the court follows
    I did refuse the offer to settle, but they have confirmed they are pushing forward with it, so is it actually likely to be discontinued? I feel like that step didn't go as per that thread for me.
  • They always say they are going ahead. Ignore. They will discontinue.

    You could have replied on day 30 after the LBC saying you were seeking debt advice and asking for a further 30 day hold. And if that 60 days delay hadn't got you there, we'd have told you to email and ask for evidence under the PAP and you'd have got it over the line.
