Company Car PCN have let it get to debt collector stage

I own a company with a small fleet of vehicles, 4 to be exact. One of our drivers has incurred a ticket apparently parking on private land (double yellow lines which we are actually allowed to park on to make out deliveries), we received a ticket from Premier Park which I ignored and has now been passed on to Debt Recovery Plus who have added £110 onto the original amount.

I did read the newbies thread and the section on company cars which only seemed to say I should appeal right away, which I have not.

It says I should appeal to the land owners, do you have any tips on how to find this out, it seems they are a residential block maybe? It is not clear.

Is it too late for this as its been passed to debt recovery plus?

The section on company cars says you must appeal it right away, however there absolutely was not windscreen ticket, it seems to be a camera that took two pictures 5 minutes apart. I am also not the driver by the way.

I can't see any more information so am not sure what I should do here. I will have a search through the forum later, I did a search on debt recovery plus but could not find any results.

I used this forum before to appeal a completely bogus parking ticket (had permit and was assisting a disabled resident of a block, completely legitimate reason to park there in his space!) and even though it had gone to court without my knowledge and I had received a CCJ I was able to get it aside and win the case. However it took hours upon hours of work to get my legal defense written up.

As there is no CCJ is this process simpler? If it is similar amount of work I will just pay the fine, even though I think adding £110 on is ridiculous. Please let me know your thoughts and what I might do next. Thank you.

Fourth post of the NEWBIES thread! Ignore DRP entirely.

Is the company in England or Scotland?  I assume West country due to it being Premier Park.

They are not especially litigious so you will probably never get a court claim but come back here if you do (2nd post of the NEWBIES thread covers winning at that stage).  Simple template.

No CCJ is risked as long as you do the above and don't ignore an actual court claim.  Easily defended because as you say, unloading is allowed on DYL which expressly allow such activity.

I hope you don't usually tell your drivers to ever pay private PCNs?  They aren't fines and are easily defended with no risk, even if initially "lost" at the appeal farce stage.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Many thanks again.

Company is in the South East of England. We dont make our drivers pay any parking tickets, we pay/appeal all of them on the company.

That is great to hear and tbh is exactly what I thought in terms of completely ignoring it. I will await the court stage if it comes to that. I will be in touch if it comes to the court stage.  Thank you again.

I am in the South too. Leafy West Sussex.

I am so glad to hear that you appeal them.

Are you aware that in many cases the company can't be held liable anyway because many private firms don't use 'keeper liability' wording?

We don't get many private parking tickets, 99% are from the council and 99% of those are successfully appealed, however sometimes you get a difficult agent there, but it only costs £35 maximum in those cases, not the £60-£170 these fraudster private companies try it on for.

I had no idea, I will keep the thread updated with any further communication or if they do indeed attempt to take me to court. Thank you again.
