DCBL/UKPC Intend to proceed

Apologies guys I'm a little late to the party here but I have already submitted my defence to DCBL and have this morning received an email to say they intend to proceed along with a copy of their N180 form.

This was my defence for context-

Dear Sir/Madam,

I am writing to appeal the parking charge notice (PCN) referenced above. I understand that an initial letter was dated August 21, 2023, and that I have previously submitted an appeal to UKPC, which was put on hold for 35 days awaiting a response. I appreciate your consideration of my circumstances, and I would like to provide further information and clarification regarding this matter.

Firstly, it is crucial to note that the letter dated August 21, 2023, was the first physical notification I received about PCN. Unfortunately, due to a breakdown in my relationship earlier this year, I was no longer residing at my previous address. Regrettably, my ex-partner was returning any mail sent to that address, which resulted in me not receiving any of the initial correspondence related to the PCN. I only became aware of the PCN when I received the letter dated August 21, 2023.

I can recall the specific incident that led to the PCN. On March 18, 2023, I took my four-year-old son to the McDonald's at Sport City for a meal. After we finished our meal and returned to the vehicle, I discovered a puncture in one of my tires. I attempted to change the tire, but my vehicle jack was faulty, rendering me unable to do so. I promptly returned to the restaurant and explained the situation to a staff member, who took note of my registration details and informed the manager.

Given that I was not familiar with the area and had no immediate assistance available, I contacted a friend from Rossendale for help. He kindly agreed to come to my aid, but his journey took around 45 minutes due to heavy traffic caused by an event at the stadium. Eventually, the punctured tire was repaired, and we left the location.

In my previous correspondence with UKPC, I provided a photograph of the punctured tire as evidence of the situation and offered to provide bank statements showing my patronage at the McDonald's restaurant on that day. If the court requires additional documentation or information to support my appeal, I am more than willing to provide any necessary documents.

I kindly request that you reconsider this appeal in light of the extenuating circumstances surrounding my inability to respond to the initial correspondence and the unforeseen tire puncture that caused the delay in leaving the premises. I believe that these factors should be taken into account when assessing the PCN.

Thank you for your attention to this matter. I look forward to a fair and just resolution.

    It's a weak defence and a shame you didn't find us earlier. You can't change the defence now without a fee, so you are stuck with that.

    But expect DCBLegal to discontinue in 2024 when your Witness Statement is better.  Which it will be because you are here now and will use our resources to make the WS and evidence strong.

    Item 7 on that list is...

    Items 8, 9 and 10 on that list might come in handy too.

    I thought as much but never had this problem before. It's an honest account of what happened though. That's good to know, going to properly go through the newbie guide once I finish work.

    I have seen the template used for WS but I'm just wondering whether you could advise me on what points to use in my defence that would reflect my case.

    Nothing much. No detail really.  Vague facts.

    If you've seen the Template Defence, you've also seen a link there to an example of how to word the bit about the new CEL v Chan appeal case.  So we assume everyone in your shoes (several defendants here per day) then just goes back a page and reads that thread and learns what sort of thing to put as the facts section.

    We don't need to advise case by case, really. Just read other threads.  Read several if you want, just scroll down the forum and gain confidence.
