Missed small money claim deadline

Yep but you could send the Chan Transcript with your N180, as seen in a thread yesterday. It's a good way to force it under the nose of the allocating local Judge.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad
I am submitting my WS soon for this case. The main crux of the defence that I am submitting is that- The Claimant has no business collecting money as there is an arrangement on site for that. Doing that is tantamount to robbing people of their earned money
- While I couldnt remember exactly what happened on the day in dispute, I have a sample of the ticket usually given on the site which states that you are allowed to stay for free for 3 hours.
- Though the ticket says free, the collector would usually demand £2 which is refundable if the supermarket purchase receipt is presented on return and on time. If more than three hours, the money is non refundable
- The main point of reference is that there is an established arrangement onsite for parking
- Do I need to post my WS or would emailing be sufficient?
- Is my defence impacted as I did not engage with any of their letters
- I have video of the attendant given people receipt and I have a sample of the receipt but the supermarket name is not on it but the supermarket is visible in the video. WOuld this evidence suffice?
- What are other things I should prove to prove this is an unjust case?
- Should I be claiming cost? I will need to take time off work on that day for court appearance

Just use the example WS x 5 in the NEWBIES thread and the a-f list of exhibits there. All stages (including costs) are covered there.

Thank you. I am going to upload that soon. Would WS need to be posted or emailing will be fine? I have a video as part of the evidence0

Send the WS in one email to the court (use court finder to get the email address) and to the claimant. You will need to check the court rules on video evidence, some require it via a durable medium.wrestpcn said:Thank you. I am going to upload that soon. I think a video may have to be filed & served separately as a USB stick sent by post.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I had an in person hearing this morning and the Judge struck out the case. Thank everyone for putting this forum together and for the support.
The judge started by saying that I have stated that I would like the court to strike out the case because the particulars of claim does not set out the conduct constituting breach. I was asked for a comment and I chose to keep mute because I was ill prepared to argue coherently by the letters of the law. The counsel sent by the claimant made a back and forth argument with the judge and the the Judge returned to me for a final input but I rambled through (not very good from me as I didnt prepare adequately)
Anyway, the Judge mentioned that a professional legal body is expected to adhere to fundamentals of laws given their experience in bringing similar numerous cases and even though she knows the claimant my decide to bring the case in a complaint manner, this will be struck out. And Phew! out it went
The other issue is I was unable to claim cost as I didnt attach it to my WS

Yay, well done!
Great Judge dealing with it fairly even though you struggled to voice your written case.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
