Smart parking fine from June

Hi guys, I’ve read newbie section but am a little lost at which part to start on now.
I received a charge from smart parking when using the local gym of which I am a member. I contacted the gym and they told me they would send smart parking a request to cancel as I am a member of said gym. This was in June and I’ve had multiple letters from debt recovery since. I’ve contacted the gym multiple times and they’ve told me it has been sent and I asked for an email so I had it in writing. I’ve now just received a letter from a law company on debt recovery behalf threatening ccj’s.
im totally stuck as to what I should do as the gym have told smart parking to cancel so I have ignored the letters assuming it would all be sorted by now.

any help would be massively appreciated.

    So I start as it’s just happened in the newbies section? Wasn’t sure where to begin as obviously it’s been months since letters and I haven’t appealed personally?

    I did see a bit on it but it said not to contact debt collector but unfortunately my wife did it a few months ago to inform them the gym had put it notice to cancel. Should I ignore that fact and carry on with the recommended advice?

    It is absolutely clear advice in the Newbies/FAQ thread that you ignore all debt collector communications. So, you need to re-read the Nebwies/FAQ thread and actually take it on board.

    You tried Plan A and they say they have ordered their agent to cancel the PCN. Did you have any success with getting the gym to put in writing the fact that they ordered it cancelled? You have already learnt a valuable lesson in that a telephone conversation is not worth the paper it is written on.

    You're too late for Plans B and C. Thankfully, you are dealing with (not so) Smart Parking and having this progress to Plan C is not very likely. So, just weather the storm of useless debt collector letters and if/when you ever receive a real LBC/LoC, go back and read the second post of the Newbies thread to know what you need to so.

    If you change address in the next 6 years, make sure that you order their DPO to rectify their data by erasing your old address and update it with your new address.

    Thanks for the help. I was just confused about wether to carry on with plan b but since it’s been so long I guess Ive missed the boat on appealing.
    I have an email from the gym stating they have sent smart parking a request to cancel it and will chase them up again on my behalf.
    As for my wife contacting the debt collector agency that’s beyond my control she did it in a panic without my knowledge.
    I’ll stick with your guidance on ignoring the letters and hopefully they eventually cancel it as my gym has requested.

  • Never mind about your other half contacting the debt collector. Just make sure that you or she do not make any further contact with them. They are just third party vermin with no rights to do anything with regards to the contract you allegedly breached.

    There is nothing else you can do now except wait and see if (not so) Smart Parking issue an LBC/LoC. Keep your written email evidence of the gym about them instructing their agent to cancel the PCN.
