McDonald's Wisemore Ocean Parking

Hi,
I just received this PCN from Ocean Parking in Walsall . On that day I have parked the car and went inside with my child and ordered. By the time the order came and we finished eating eating almost 40 minutes have passed. There weren’t any big signs stating that the maximum period is of 20 minutes. McDonald’s didn’t informe me and I only saw that you can register for parking on another day(that will be another PCN). There is no way of seeing the registration for parking or any other information if the place is full of people. Every McDonald’s I’ve visited has a policy of 1-2h. There is no way of ordering, eating especially with children in 20 minutes. Do I have any grounds of appealing this? Thank you!

Welcome. Please carefully read and digest the Newbies/FAQ thread which contains all the information you need. Your appeal to the PPC is just Plan B.
Plan A is to complain to the landowner and write to your MP to get them involved. Plans C and D are also expained in the Newbies/FAQ thread.1 -
Thank you for your response. I have read the thread but honestly, I don’t know how to apply it to my case. What wound be the next step? Go on their website and apply with the template “one size fits all”? Thanks0

I have read the thread again on my laptop and plan A doesn't work because my complaint to McDonald fell on deaf ears, absolving themselves of any responsibility. I guess plan B?

The event occurred on the 01/10/2023, the issue date of the PCN is 10//01/2023 and I received it on Monday 16/01/2023. Is this POFA compliant ?0 -
Something wrong with those dates there. Is it a typo or is it possible that the first 01/10/23 is referring to the US way of writing the date and it is in fact 01/10/23 OR did you n fact mean 01/10/22?0

The date you physically received the NtK is irrelevant. It is the "deemed" date that you received it that counts and to work that out you can either take the postmark on the envelope, if it has one, or else the date of the NtK to work out the "deemed" date of delivery, which is two working days after that date. A date that is a Thu or Fri will be "deemed" to have been delivered on the following Mon or Tue (unless a bank holiday is in effect).
So, is the "deemed" date of delivery more than 14 days after the alleged contravention date? Of course, this all depends on whether the PPC is relying on PoFA in the first place.1
