Civil Enforcement Ltd claim form from back in summer of 2023

Hi there,

I've ignored previous letters and have recently been sent a 'Claim Form' which has a 'The county Court' stamp on with the claimant being Civil Enforcement Limited.

From what I can remember, I believe I overstayed the time in the retail car park by approx 25 minutes. Am I bang to rights here and will have to pay this, or do I have a chance in getting out of it?

This letter was issued on 12th Oct 2023 and has court fees and legal representative costs on there too.

    *The title should've read that the fine was from summer of 2022, not 2023.

    You should file your AoS by Tuesday 31st October but there is no advantage to delaying it. You will then have until 4pm on Tuesday 14th of November to file your defence.

    Have you read the second post in the Newbies/FAQ thread yet? Also, you will need to adapt the Template defence thread by adding a couple of new paragraphs at the beginning and embed a copy of the recent appeal transcript from the CEL v Chan judgment.

    As for your defence, if the claim isn't struck out for the woeful PoC, why do you think you may be "bang to rights"? Were you fully aware that you were overstaying? Were you fully aware that you could be liable for a £100 charge? Was the signage obvious and prominent? Did CEL fully comply with their ATAs Cop?

    With a Claim Issue Date of 12th October, you have until Tuesday 31st October to file an Acknowledgment of Service but there is nothing to be gained by delaying it.. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 14th November 2023 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Thanks for your help. I wasn't fully aware I was over staying. Nor was I aware of the charge of £100, however I cannot remember what signage there was in the car park due to this being approx 15-16 months ago

    Can you show us the Particulars of Claim on the N1 claim form?  If you scan and post a picture, make sure to cover all personal info, especially claim number and password for MCOL

    No need as it's already linked and explained in the Template Defence as an option.

    We need to see the rest of the POC (numberplate redacted) because that photo doesn't show the rest.  Location, dates, etc.
