suing euro car park

Hi, 
Any ide if I can sue Euro Car Park. I am renting ( monthly pament) car park thru just park. I have received 5 parking tickets already for last 2 weeks. The first 2 parking tickets I got cancelled thru appeal as I provided them with recepie for monthly payment. However 3 days after cancelling my first 2 parking tickets I received another 2 for different dates ( still within the dates I have provided them bills for) yesterday another one appear. I am kind of tired of keep appealing every day. Whenever I see new parking ticket appearing it causes anxiety. Then I need to pend some time with writing to them.

  • You can sue anyone. However, more detail would be necessary if you are seeking advice. What is the contractual relationship between JustPark and ECP? Has someone conned you into paying for a parking space that they have no legal right to offer you?

    Yes you can sue them but send a LBC first and a warning to cease and desist.

    I've had a look at the Just Park website, I'm only guessing but I think the owner of the space you're paying for is renting it out to Just Park who are renting it out to you in turn. It may be ECP do not know this which is why they keep issuing PCN's , either that or possibly the owner is not permitted to rent the space out to someone else. 

    In your shoes I would contact Just Park, explain the situation and get the facts straight rather than go into unarmed combat with ECP whose fault is may not be. Ask Just Park to investigate and resolve the situation or refund whatever you have paid for the space and settle the PCNs you received through no fault of your own.

    No-one should be settling any PCNs.  This is the fault of the faceless ANPR system used by ECP.

  • i don't think its a scam as as all tickets I appeal to euro car park getting cancelled. I provided them twice copy of same monthly payment to justpark. So they are aware of the rental. No idea why I still get new tickets which eventually will be cancelled when I will send them exactly same paper as before (proof of monthly payment to just park). For now I am just collecting the tickets and then when I will get close to 28 days past issuing them by ECP( thats's the time to appeal) I will appeal one by one to each of them. Just it is so irritating, I think they getting on me as after second ticket I wrote them email with copy of montly payment and note I require £100 as compensation for wrongly issues tickets. They never replied but....
