Stevenage Leisure UKPC Parking Fine

Hello! New to the thread but have spent some time going through the board and read the newbies post which was helpful in my first appeal. I've now received further correspondence from UKPC who are now suggesting the registered keeper can be pursued for unpaid charged as I didn't identify the driver in my appeal.

For context - UKPC operates the car park and the car was parked with the rear tyres just over the white markings on the bay (ie not fully in the space) and they are now claiming breach of the contract. It's scandalous as the road behind is about 2 cars wide and the car park was near enough empty at the time. They submitted photos in their first complaint (which was a PCN on the window) and I sent the template appeal.

Their response is below. What is the suggested next step here? Is it to ignore this request and just get a POPLA code and appeal there instead? Or should I respond with something to delay the process further? (Without naming the driver)

I haven't yet submitted a complaint to the owner - past posts suggested it is JLL but other than on this forum I can't find anything to actually confirm/verify their ownership!





To assist us in making a decision regarding your appeal, please confirm the full name and address of the driver to
our Appeals Department within seven days of the date of this letter.

Schedule 4 of the Protection of Freedoms Act 2012 discusses the recovery of unpaid parking charges. It allows
parking operators to hold the registered keeper liable to pay unpaid parking charges if the operator has not been
provided the name and a serviceable address of the driver.

The parking charges issued by UK Parking Control Limited are based on a contractual agreement between UKPC
and the driver, as detailed on the signage displayed in the car park. The signage states the terms and conditions
of parking and explains that a parking charge will be payable if the terms are not met by the driver. We ensure
that signage is ample, clear and visible, wholly in line with the British Parking Association Code of Practice. It is
settled law that a driver is deemed to have accepted the terms and conditions of parking by the act of parking
and leaving a vehicle.

This information may be confirmed by submitting another appeal on our website at www.ukpcappeals.co.uk, or
by post to the address overleaf. Please ensure that if writing to us by post that you include the parking charge
reference number and vehicle registration.

Failure to provide this information will give us no alternative other than to make our final decision based on the
previous information received. At this stage a POPLA verification code will be provided.

The parking charge has been placed on hold whilst under appeal and may be settled in full at the current PCN
rate of £100.00.

    The usual way to see who owns the land - if it is a shopping area - is to look at the welcome signs at the entrance.  JLL have proved helpful in the past.  Just do nothing and, in time, the PPC will reject your appeal and, if UKPC stands for UK Parking Control, you will receive a POPLA code.  What is the full name of the PPC?

  • You have not received any "fine". Get the idea out of your head.

    As you received an NtD, please tell us the date that you received it and the dates that are on each of the NtKs that followed.

    This site has always be a predatory hunting zone for parking companies and previously clampers.
    I wouldn't worry about it too much. UKPC cases often get binned prior to court, they push it all the way on the off-chance. 
    These cases aren't winning material for parking companies at court. You've got a reasonable explanation and I'd advise you to read through the newbies thread, search for other cases at this site and other cases regarding" vehicles not being fully parked in marked bay" as you can gauge how ridiculous this is and how to beat these clowns.

    I received the PCN on car window on 22/08/23, submitted my appeal (copy paste from these forums) on 17/09/23 and received their response (the one copied above) on 11/10/23 giving me 7 days to respond so I have until 18/10/23 according to them to submit the name and address of the driver.

    Do I just ignore this or go back with any further comment? Understand the next step they will give me a POPLA reference

    And yes, the PPC is UK Parking Control

    That's not what might otherwise be known as a 'welcome plinth'.

    We are thinking about a 'totem' style sign like this one...
     
    ...which has at the bottom...
    "owned and managed by Hargreaves" with their contact details.

    But that image definitely is not in Hertfordshire - just an example.
    Where exactly is the car park you are having problems?

    We said to look at the Welcome Plinth. 
    You know, the big concrete thing listing the shops in bright colours to catch your eye and entice you in.  The thing that's at the entrance of pretty much every retail park that welcomes people to the site and says who runs the place, at the bottom. 

    Not a UKPC sign.  At no point did we tell you to go look at a UKPC sign. Of course that isn't what we mean.

    There's never a 'Welcome' shown on any PPC sign. In most cases it's a serious warning to get the f**k out of the place!  Outlaw territory!

    Have they sent you a NtK yet? If not, you have a couple of options. One is to just ignore them and wait for them to issue a POPLA code or you could, as their correspondence suggest, appeal again (restarting their clock) but this time just ask why they need the name of the driver when they are dealing with you as the RK. You are dealing with intellectually malnourished vermin and tying them up to day 56 without having issued a NtK is just another winning point for your subsequent POPLA appeal.
