ECP DCB Legal court claim

Apologies I couldn't find a thread on this and starting to panic
Long story short had a PCN for a Euro Car Parks where I had got confused about 20 min free parking and parked on wrong car park (train station in Wolverhampton multi story and Cornhill Street Station are next to each other)
We never received the initial letter which would have said to pay early and reduce the fine and our first interaction was a threating letter from a debt collector and no option to appeal
We asked for a SAR and they sent a copy of the letter they allegedly sent but we never received it
Queue a year nearly of letters from other debt collectors and this morning received one from QDR
Is there anything to be gained by reaching out to Euro Car Parks to offer to pay the initial fine? My wife is pregnant and this is really start to stress her out now
If it went to court could we offer to pay the initial fine to be done with it
Any advice greatly appreciated

Is there anything to be gained by reaching out to Euro Car Parks to offer to pay the initial fine?If it went to court could we offer to pay the initial fine to be done with itNope. And Nope.
If that was an option the NEWBIES thread would say so. Stop taking this seriously.
It's also not a fine.
A QDR letter is merely sent by ZZPS which also uses letter heading in the name GCTT.
QDR do not start claims for Euro Car Parks.
This letter is hot air. Nothing is likely to happen. It has not become serious. It's still ZZPS. Ignore them.
WE MEAN: totally ignore unless you get a court claim, apart from complaining to the landowners or retailers. They can cancel PCNs in seconds.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Loud and clear
Will ignore until we get a court claim
Is it worth trying to pursue a cancellation of the PCN all together then with ECP or have I misunderstood?0 -

No chance of talking to ECP. Not when the case is with ZZPS. Let sleeping dogs lie.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all
We have now received a letter from HM Courts and Tribunal Services about this.
Will go to the Newbie thread when I know what I'm going to do with it but unsure what action to take...
Is it worth offering to partially pay , and offer the amount that would have been if we could have paid early and use the defence that we never received the letter?
The fee has almost doubled now on the court letter too to add to the stress
Any help and patience greatly appreciated

Definitely not, leave any offers to the mediation stage, assuming that you want to actually make an offer. ?
We would tell you to not offer anything because ECP and DCB legal tend to discontinue a few weeks before any court hearing. There are over 430 examples of discontinuations in the thread by Umkomaas
Not receiving paperwork is no defence
Name the legal team acting for ECP
Post the issue date on the top right of the claim form
Also post a redacted picture of the POC on the bottom left of the claim form too ( after hiding the VRM details first. )1 -
Hi, thanks for replying
DCB Legal are the ones on the claim form
21/11/2024 is the issue date

21/11/2024 is the issue dateWith a Claim Issue Date of 21st November, you have until Tuesday 10th December to file an Acknowledgment of Service. Do not file an Acknowledgment of Service before 26th November, but otherwise there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 24th December 2024 to file a Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.1 -
Thanks for the reply , my wife (whose name is on the letter) doesn't want to go through all the steps as she's worried about rising costs should they not back down etc
There's mention of the mediation stage above? Is this is reference to offering to pay a partial amount of the fine with your own justification?0 -
There won't be any rising costs, if she was unfortunate enough to go all the way to a hearing in court and lose, the typical loss is about £212, less than the amount on the claim form
There was no fine, there is no fine, just an unpaid invoice , a typical invoice is £100
A without prejudice offer could be made at the compulsory mediation stage, say £30 , no need to justify anything, mediation is about reaching a compromise figure that both sides will accept, nothing to do with the details of the claim1
