Mums inheritance in Dads name

    Would the fact that all the money from the estate went to my Mum, and then there are various gift payments made which is detailed by the solicitor and then at the same time a payment goes to a newly opened ISA account in my Dads name which is not listed as one of the gifts count in our favour?
    The only meaningful facts are that your mother inherited the money and it was then paid into an account in your father's name. 
    Any gifts from the grandparent's will are irrelevant.

    Forget gifts from the estate. They are not relevant.

    The money went into your father's named account.  Once in his account it belongs to him.

    Without evidence to the contrary  it could be considered a gift from your mother to your father.

    There is a prior pattern that all the couple's money was in his name.

    Are there assets over and above the £40K. If and when your Dad needs to go into care, then would he be self funding anyway or only because of the £40K in his bank account?

    No this is it. There's roughly £10K in their joint account, the house which won't be considered as my Mum still lives there and my Mums inheritance which is in the account in my Dads name.

    My Mum is, not surprisingly, very worried. The inheritance money has always been the safety net for when she is left on her own and income drops as my Dads pension is no longer coming in.

    No this is it. There's roughly £10K in their joint account, the house which won't be considered as my Mum still lives there and my Mums inheritance which is in the account in my Dads name.

    My Mum is, not surprisingly, very worried. The inheritance money has always been the safety net for when she is left on her own and income drops as my Dads pension is no longer coming in. 

    I would get it put into joint names asap.

    You can't put an ISA into joint names.
    But it can go into a joint account other than an ISA.
