The money went into your father's named account. Once in his account it belongs to him.
Without evidence to the contrary it could be considered a gift from your mother to your father.

Are there assets over and above the £40K. If and when your Dad needs to go into care, then would he be self funding anyway or only because of the £40K in his bank account?0

No this is it. There's roughly £10K in their joint account, the house which won't be considered as my Mum still lives there and my Mums inheritance which is in the account in my Dads name.Spendless said:Are there assets over and above the £40K. My Mum is, not surprisingly, very worried. The inheritance money has always been the safety net for when she is left on her own and income drops as my Dads pension is no longer coming in.

You can't put an ISA into joint names.1
