MET Parking , DCB Legal court claim

The hearing would be at the end of the month. Any help would be appreciated, I am a bit nervous as I don't know what to say and how long it will take.
I did NOT mentioned VCS vs Carr in the WS at the time as I didn't know about it. All I have mentioned is proof of the old adress where the correspondence was sent.
Is the hearing going to be about the two parking fines and the motives that I ignored them ? Or what should I expect and please how should I prepare. Thank you.0 -
I already stated what to do if your WS bundle didn't yet include VCS v Carr:I assume you did submit a WS mentioning VCS v Carr?Search the forum for
If not, you will have to file & serve a Skeleton Argument now to add it and other case law to your case. We can help you prepare that.
Loads of case law helps you, including the new Mazur case.

No, whilst you MUST be familiar with and able to voice your main defence points against the PCNs if asked, this hearing that you paid for is NOT about the PCNs. It's about setting aside an irregular CCJ where the claim form was signed by a non-solicitor, Sarah Ensall, who is not authorised to conduct litigation (see Mazur case).
And you had defended the claim in 2023 but the court and Claimant then sent the N180 to an old address and failed to note that you'd moved (...you did tell them??).
What EXACTLY did you email as your defence in 2023? Show us. Don't reply that you haven't got your defence (you have because it was a PDF attached to an email in 2023). Show us.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My defence was a rushed copy paste tbh

Looks fine. You certainly have prospects of a successful defence so I wouldn't worry about that but have it to hand in case the judge asks.
But thus hearing is about setting aside the CCJ because you clearly defended the case and a house move caused you to muss a step.
Also, if the judge looks to be not really with you (because the above situation isn't the Claimant's fault) you could throw in Mazur v Speechlys (search the forum!) because any DCB Legal claim form from 2023 was probably signed by a non-solicitor which is improper.
Did you tell the CNBC when you moved?
Did you miss receiving the N180?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

MET PARKING , DCB LEGAL court claim1 -
I believe I have sent the Aknowledgment Letter in Nov 2023 online on moneyclaim with my previous adress by mistake
I don't remember telling CNBC when I moved
There is a previous email sent to DCBL earlier in 2023 with my current address and details though.
I don't know what the court sent after that (after sending my defence in Dec 2023)0 -
Oh dear. Good luck explaining that to a judge. The court service isn't psychic.
You really really (really!) had to tell the court your new address and you would obviously get a CCJ that way. Everything re claims is sent by post and you then breached a court order by failing to respond at N180 stage.
That's why you got a CCJ.
This is worth adding to your bundle though, as you can use this to shift blame to DCB Legal, plus use Mazur v Speechlys if the claim form wasn't signed by a solicitor (who signed it?):

Just received this by email

Well now: that is pretty good in your case and it accepts that the claim will be dismissed, so the entire claim is over.
In your specific circs - they served the claim correctly then you were the party at fault, as IIRC, you didn't tell the court you had moved - that draft order is worth taking, IMHO.
You were always unlikely to get any costs.
Unless you are determined to have your hearing and try for your costs (court fee) back, I'd email back and accept that draft order and ask for it to be headed as a 'consent order' with signature/date boxes.
Then you can send that (once signed by both parties) to the court next week and ask for the case to be disposed of without an attended hearing: CCJ to be set aside and claim dismissed, per CPR 13.3 in view of the 'good reason' that there was a discrepancy in the address and both parties agreeing that the court form (N180) was not served and the Claimants knew this in June 2025.PRIVATE 'PCN'? County Court was in the CC in the email received. I have replied all yesterday asking for the 'consent order' dated and signed as you suggested,no reply yet. I have to mention the hearing should be next Friday.0
