A lot more hassle and cost, the £2,600 deposit you should get back, but the £302 court fee and cost of getting a solicitor involved to help drafting the legal basis of the claim and to assist with formal service of the order probably would not if the company does the sensible thing and pays immediately, using evidence of payment to get the claim dismissed. Winding up orders are normally used by large creditors with 5 or 6 figure sums owed and a genuine belief that the debtor is technically insolvent.MDMD said:Just out of interest does anyone know if it is possible in such circumstances to just issue winding up Proceedings?
