In theory you can make a stand-alone application to strike out the claim but you will need to pay a substantial court fee. I haven't checked lately but my recollection is it's £175. I wouldn't go to that expense even if the application ultimately succeeds and the claimant is ordered to pay your court costs. I'd just argue for the the strikeout at the same time as making all my other arguments at the witness statement/skeleton argument stage, if the case even gets that far2

Quick update: After several attempts by DCB Legal to make contact by phone and email, and despite their offers of settlement, which were ignored as recommended here, I received a letter from the court stating that the claimant had to pay by 4th July or withdraw the claim. They chose to withdraw the claim a few days ago. Many thanks to everyone who helped!3
