So I have received an email from DCB legal today, 2 weeks before I am due to submit my WS :

    NOTICE OF DISCONTINUANCE:

We act for the Claimant in the above matter.  Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s Notice of Discontinuance for your records. The attached has also been filed with the Court. We will now proceed to close our file accordingly.

Thank you all for the valuable advice you have given on this website, glad I stood my ground and refused to be bullied by these parking cowboys, despite my family and friends urging me to "just pay and avoid the hustle".  I am elated!

Yay!  You won. Congrats. It's over!

Can you show a photo (data redacted)?

Just wanting evidence as some posters here have referred the Justice Committee to look at our 'record of DCB discontinuances' and we don't want it called out as 'hearsay'.

We will add you to the disco thread.

On to it. Coming in thick and fast now!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • How much will this have cost them since they started these attempted proceedings ?  Court fees?  Filing fees?  It must be cheap for them to risk such easy defeats

The model is hugely (abusively) lucrative for the legals.  Well worth the £35 claim fee (a bit higher for larger claims) for DCB Group, when 90% of them - close to a hundred thousand claims they file per year - go straight to a CCJ.

SHEDLOADS more (probably at least ten times more, I guess, so over a million cases per year, I'd guess) get paid at £170 per PCN at 'scary letters' stage, or on sight of the court claim.

And who knows who is keeping the 8% interest? That can add hundreds.

And who knows which DRAs are (or are not) collecting VAT from the PPC on the debt 'fee' element?  Unlike the PCN, it's not VAT-free and the consumer can't lawfully (so says HMRC) be required to pay the VAT element of debt/enforcement fees.

Who knows? It'll all come out in the end.

Great you've been added to umkomaas discontinuations list. As you didn't receive PPC's correspondence please @kiki59 consider supporting this

PPCs always claim discounted rate/full rate pcns and court claim letters were sent  but no proof is offered. As operators CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and include it in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.
