DCB legal Parking Fine

Hi -Over a year ago I was working and staying in Shrewsbury at The Lion Hotel. I arrived, parked and as I was staying a few nights I went into the hotel and requested to pay for parking for the length of my stay. Several weeks later I received a letter from Parking Eye claiming that I didn’t pay. I wrote and enclosed a copy of my hotel receipt and bank statement showing payment. I heard nothing back so assumed the matter was resolved. This year in May I received a letter from DCB legal claiming I owed money for non payment of the parking at The Lion Hotel. I emailed and said that I paid my original parking and assumed the mater was settled. They replied by saying the time for appeal had past and I should pay them over £170. The matter has now gone to court. I have sent my defence in and have been contacted by email by DCB legal asking for the proof of my claim. I emailed them the proof and they said their client hadn’t received payment. I had paid £15.00 for three days stay. They then informed me that the payment amount should have been £10 a night and emailed photos - which had no dates on them so I  have no proof that their prices haven’t increased since my stay. I told them the amount I paid was in good faith and their issue is with the hotel and not me. 
They tried to get me to call the office to settle the claim which I refused - I want everything in writing. 
Legally where do I stand? 
They are claiming a settlement figure of £272.96 to ‘help the court out’! 
I paid in good faith (The amount I assumed I needed to pay) 
The Hotel and the PCN company obviously have an issue with each other and customer are dealing with the fallout.

    Have you complained to the hotel, as a genuine customer, and asked them to intervene?

    What kind of defence have you submitted?  Can you copy and paste it here so that we can advise on what your next move might be?

    While you need to go through all the required court stages, you might get some comfort from the following thread ...

  • You are dealing with the intellectually malnourished DCB Legal. When you say you have "sent your defence", are you telling that you received a claim form from the CNBC (formerly CCBC)? If so, what was the "issue date" of the claim?

    What exactly did you put in your defence? Did you submit your defence using the MCOL webform?

    In most case we deal with on here, when robustly defended using the defence template, DCB Legal usually discontinue before it ever gets to a hearing.

    Did you ever try Plan A and complain to the hotel?

    Firstly, you do not owe £272.96. This is a scam by DCBL  AND Parking Eye has joined in the scam

    Help the court out ????   what jokers, With the DCBL terrible record of discontinuations ..... they just waste the courts time ?

    Did you actually pay the hotel the £15 and how did you know it was £5 per day, how did the hotel know ?
    Even with the so called discounted amount, how many tickets did you get 

    The pictures DCBL sent offer no proof without a date. Within the year the prices could have changed.
    You require proof on the 3 days and dates

    The hotel will hold the key to this to which you have serious questions to ask them .... as above

    Legally where do I stand? 
    You'll win as long as your defence wasn't weak. DCBLegal will discontinue without a hearing. 

    Show us your exact defence you put in, please. 

    They are claiming a settlement figure of £272.96 to ‘help the court out’! 
    They always do that.

    Ignore it and when you get a hearing date, do  decent WS and evidence bundle like the one seen in the thread by @vincentvega27

    I received a N1SDT form. I went online and filled out the defence section. My defence :

     Defence
    I paid for this parking on arrival at The Lion Hotel on 05/06/22 at 18:37:48 for the 3 days/nights I was staying at the hotel. I went to reception and asked the gentleman on the desk if I could pay for my entire stay and payment was taken. I was very shocked to received the claim from Parking Eye. On looking at the hotels comments section I discovered that this has happened to a lot of the guests. I wrote to the company on receipt of their letter and sent a copy of the receipt and a copy of the payment on my bank statement to them and didn’t hear anything so assumed they realised their mistake. I was even more shocked and annoyed when Igot a letter from DCB ltd in May this year claiming I owed them money. I emailed them saying I had already paid for parking however they responded saying the timeframe to appeal had expired, even though I had appealed as soon as they issued their alleged claim. I have copies of the receipt and my bank statement I can provide as proof of payment.

     The hotel say it’s a matter between myself and the parking company. 

    DCB legal claim the money was never received by their ‘client’ 

    We write following your recent correspondence. 

    We have reviewed the information provided with our Client who has confirmed they were not in receipt of the payment of £15.00.

    In any event, we refer you to the signs attached. They clearly state that parking for The Lion Hotel for a period of up to 24 Hours is £10.00. On the date of the PCN you remained on the Land for a period of 12 Hours 59 minutes. 

    You have stated in your defence that payment for 3 days was made in the sum of £15.00, which you will note is not the correct payment amount.

    Despite the above, in the interest of assisting the Court in achieving its overriding objective, our Client is agreeable to settling this claim. We ask that you contact the offices to discuss this further.

    The hotel cannot say ... "The hotel say it’s a matter between myself and the parking company." 

    If you paid the hotel direct it is 100% their responsibiliy
    I WILL ASK AGAIN ....

    The DCBL claim is a fake... there are no damages, , Parking Eye do NOT own this land 
    No doubt this Fake claim was signed by YASMIN MIA ???
