If a car is repaired at another garage under warranty, but the initial garage you purchased it from are also liable under the consumer rights act, can I pursue them for a courtesy car while the repair is done?

    Does your contract of sale say that they will always provide you with a courtesy car irrespective of who does repairs?

    Under the CRA you can look at consequential losses however you also have a duty to mitigate your losses... is the vehicle immobile hence why its got to go in when no cars are available? Did you give the retailer the opportunity to deal with it?
  • Yeah my car requires a new engine and the fault occurred 21 weeks after purchase. I took out a 3 year extended warranty with RAC and assumed I had to go through them, they are now being very difficult and saying driver damage. I was not aware of the CRA until the weekend or I would have gone straight to the garage. Under the warranty I could go to any VAT registered garage, this was on the warranty website as a recommended local garage.

    A lot of warranties have clauses that a temp car is not supplied, so any car has to come via the dealer.

    The cause needs to be established. If it is driver damage due to eg not checking the oil and running it dry, then I would suspect you have no entitlement to a courtesy car. Otherwise you may be able to argue the point.
