Letter Before Claim CST LAW, Premier Park Ltd. Received today.

Help please.
Parked in Premier Park location Nov 2022. Didn't open my post so missed official appeal window.

Visited shops by car park - would not help.
 
Wrote to Premier Park with photo evidence supporting an appeal (and made mistake of saying I was the driver). Premier Park responded saying "no longer able to deal with your case at this late stage as it is now being dealt with by our collection agency"

Was chased by DRP.
Tried to engage with DRP. Over the telephone they acknowledged receipt of my appeal letter to Premier Park but said it was outside the appeal window.

Then read the advice on this forum. Ignored all further correspondence  - just filed it.

Chasing letter from CST Law received 21/9/23 - filed.
Letter before claim received today. Date on LBC over a week ago!! Photo of first page of letter attached. 13 pages of letter, 2 paged form also included.

Very appreciative of the support you give on this forum. What do I do next?

  • You should respond to the LBC robustly. Nowhere in their letter have that stated the cause of action.

    It has failed PAP 3.1(a)(ii), 3.1(a)(v) and 3(b) (i), (ii) and (iii).

    Just respond and deny the debt.  You could ask why they've added £60 which was not on the signs.

    That'll do.  No SAR.

    As said by Coupon-mad, ask them about the fake £60   ..... , many have asked but CST will not reply

    If CST actually take this to court they will have to explain to a judge the fake £60 and if they sign a statement of truth for a fake, a judge may well consider it as contempt of court

    Over to you CST ... BEST PULL OUT NOW before a court spankimg

    Is there particular wording to use in a letter to 'deny the debt'?

    I noticed this in the post#1 on Newbies. That I could adapt. (hope it was ok to copy and paste in here). Thank you in advance.

    Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.


    THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE, OR IN THE RELEVANT BOX ON THEIR APPEALS PAGE.

    No template is needed to write four words.

  • Second letter received today (first letter was Oct 2023) 

    Do I need to write and deny this claim again? 
    They are using the same Ref number and I haven't had any other parking charges.

    If I do respond will it help at all if I send it registered so have a signature at the other end?

    (Is this going to continue until the 6 years are up?)
