ULEZ -- New Car

We have  bought a car that was in the ULEZ. The car was bought on the 23/09/23 and delivered to the north west on the 26/09/23. We had a fine issued by " The City Of London" on 03/10/23. In the paper work provide bye the dealer he has put the delivery date as the same as the purchase. 

As we did not receive the car until the 26/09/23 we will be challenging that we were not the owner at that time. The V5 was issued on the 29/09/23 and we did not receive this until 02/10/23 which is when we taxed the car. ( Old V5 could not work for taxing the car ). Is this a reasonable argument? 

I did have issues with the site when we travelled on the 23/09/23 as it was not clear if I had to pay. However the car we used met the ULEZ criteria.

I expect we will have to appeal. Is the fine frozen? Do we have to attend the appeal or can we make a written statement? Any advise welcome.

    Read the sticky 'Read this before you post' as well as reading through some of the other threads there ahead of posting your own details, to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate), as they need to see all the small print.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Are you sure that the letter is ULEZ related?  If the document says 'City of London' that is the local authority for the Square Mile (financial district) - I'd say it's more likely to be a yellow box or bus lane type issue.

    Transport for London is the authority responsible for ULEZ - the words 'City of London' won't be used for anything ULEZ related.
