Smart Parking parking charge notice

Hi, I can see plenty of knowledge on here re appealing a Parking Charge Notice, so here goes. Initially was thinking of begrudgingly paying it just to get it cleared up, but the charges are a disgrace and totally disproportionate. I received the PCN after my car was photographed overstaying a 1.5 hour free stay car park by approximately 33 minutes. Date of contravention was 25/08/23. On 03/10/23 (39 days after the contravention) I received the Smart Parking PCN through the post, showing an outstanding amount of £100 but this would be discounted to £60 if paid within 14 days of the notice issue date. The issue date of the PCN is 25/09/23, again I received it in the post on 03/10/23, therefore reducing the timeframe to appeal or to pay the reduced rate to 6 days. I was hoping to go straight to the blue template on this forum but I can't seem to guide myself to it. I've not contacted Smart Parking at all so there's no admittance as to driver identity, if that's relevant. Any help appreciated.

    The template appeal is in the NEWBIE guide, which is one of the five announcements on page one of the forum, from here, it is one click back and it starts **NEWBIES .......
    When you click on it, it will be at the bottom of the thread so you have to scroll back up to find the beginning.  There is only one bit of text in blue.
  • Thanks Le_Kirk, unfortunately I'm still struggling to find it. I'm not finding it the most user-friendly forum but having said that I'm not the most experienced on these things either

  • I guess my only chance is that it took 39 days for them to get the PCN to me, and the driver isn't identified, only the vehicle owner. Therefore, short of the template, is there any standard text I can write into the appeal based on either or both of those two items?

    You've already been told to read the Newbies/FAQ thread. Thousands of users of this forum are able to find it. It is on the home page of this forum. There is a template appeal in blue in that thread that you should use.

    You cannot lose at POPLA v Smart Parking and could not wish for an easier one.

    And on every page there are two links back to page one. My signature tells you what the top one looks like.  Would take you half a second to locate the NEWBIES thread.

  • Yes, I found the template, thanks.
     I'm guessing I need to doctor it slightly, as follows?
    There are two images of the vehicle on the PCN, therefore should I remove from the template: "as well as your images of the vehicle"?
    Also the following doesn't seem to apply to my case: "If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it", therefore should I remove this statement?
