  • I captured the VCS letter from the webpage and put it in a word Doc but I'm not allowed to send it here. Sorry - I tried. I'm not good at these things! maybe the MSE forum will let me do it one day soon.

    Screenshots saved to photos can be shown by a newbie using a phone.

    We need it today please, as the Government's Call for Evidence closes tomorrow, so it can't wait if you want this behaviour alerted to the DLUHC, who will read all submissions.

    Here is a copy and paste from the pdf that I was sent. I could not do pictures. I am doing this on a desk top - not a phone.

    Please note that the original Charge notice I was sent was a 'Charge Notice to Keeper' and it was posted to me on the 15/09/23 but I only received it on 25/09/23 - thus giving me only 4 days to appeal. I told them this.

     Contravention Date: 09/09/2023

    We refer to correspondence received from you concerning the above numbered Charge Notice. Please note that responsibility for this Charge lies with the driver of the vehicle at the time the contravention was observed. However, we are unable to ascertain who the driver was on the date in questions from the information given within your appeal.

     In order for us to process your appeal correctly, please follow the instructions below:
    1. Notify the driver of the vehicle that they will need to appeal to us directly, including their FULL NAME (Forename and Surname) and a valid FULL SERVICEABLE HOME ADDRESS within 14 days.

    2. If you are representing the driver we require a signed and dated statement from the driver of the vehicle confirming that you are authorised to appeal on his/her behalf; this needs to be an original signature and not a photocopy or a stamp.
    The statement MUST contain the drivers FULL NAME (Forename and Surname) and a valid FULL SERVICEABLE HOME ADDRESS. Please ensure that correspondence is submitted through the portal www.myparkingcharge.co.uk in order to correctly adhere with the appeals process. 

    OR 3. Pay the PCN. Payments can be made online at www.myparkingcharge.co.uk by following the links for "Pay Now", or over the phone by calling 0845 226 9138 and using a valid Credit or Debit Card to make payment.
    It is your responsibility to ensure that payment is received within our office by the date specified.

    As a gesture of goodwill we have placed the charge on hold for an additional period of 14 Days to enable one of the above actions to be complied with.
    We are willing to re-offer you the original discounted charge of £60 as full and final settlement of this Notice, if payment is received within our office on or before the 18/10/2023.

    If payment is not received by this date, the amount payable will revert to £100, payable by 01/11/2023. Failure to pay this charge within the stated times, may result in Debt Recovery action been taken and further costs up to an additional £70.00 been incurred.

    What a mess this thread is in.

    Firstly you told us that VCS wanted to know who the driver was.
    Several people told you not to disclose the driver's details.

    You then said that VCS had rejected your appeal, but the email you have shown us today says no such thing.

    The replies you received yesterday were all good.
    Here they are again...
    "Don't, under any circumstances, tell them the name of the driver."
    "
    Do not, under any circumstances identify who was driving."
    "
    the RK cannot be held liable, only the driver and we know that they don't know the identity of the driver".
    "
    Don't bother responding to that. Wait for their appeal refusal"
    "
    It's clear that the message is - DO NOT DISCLOSE THE NAME OF THE DRIVER."

    I am just going to repeat what I wrote yesterday...

    The VCS letter tells me the appeal cannot be ' processed correctly'  because I have not (and will not) disclose the driver.
    In the document I am offered 3 options, all of which I am not going to take.
    If the appeal cannot be 'processed correctly' what does this mean? That the appeal can not go ahead? That the appeal is rejected? That the appeal is not going to be processed? That I have to wait until after the 18th to hear what they have to say when they realise I wont tell them who the driver is?
    I am presuming that the appeal has been rejected if they can only send it to the driver and they don't know who that is. This is not an unreasonable assumption considering everything.
    I apologise for being premature in my assessment and I will have to wait to write the same thing again after the18th.

    I have learned a huge amount in the last few days and I cannot pretend to be perfect - I make mistakes and I cannot deny that I have found all of this quite stressful. The hanging threat from VCS perhaps skewers things a bit. 
    The word 'Newbie' does mean something you know!
    I thank you all for your patience and advice.

    I'd reply telling them you have appealed as registered keeper against the suggested liability, and you will show this to the Government if VCS keep refusing to let a keeper appeal.

    My persistence to stand up for what I believe is right has - perhaps unbelievably - got results !!!!
    Leeds Braford Airport is getting VCS to cancel it's 'fine' demands after seeing the video of my car on the night in question. I have been told, by email, from the Manager of Customer services, that I will have no further problems with this.

    I had escalated my complaint to the Airport customer services Manager and was willing to do whatever it took to have the the issue looked into, including contacting my MP etc etc.
    I would say to anyone with a similar problem to not give up or give in - fight for your right to be heard and treated fairly.
    Many thanks to everyone who gave me advice in this thread - and good luck to Coupon-mad.

    And yeah, I'm absolutely on the case of stopping PPC World from preventing keepers from appealing.  All over it, don't you worry.
